"Others want it to go away so that things can be the way they have always been in Commercial Group." "But it's hard to see the genie squeezing back into the bottle at this point. Employers save too much and employees like it too much." The above is taken from the 2024 Deft Research Executive Research Brief. The chart below reflects "six times as may former group members are more satisfied with their coverage after moving to the ACA through ICHRA than are those who are less satisfied with ACA coverage." "95% indicate they are as satisfied or more satisfied now with their coverage since they moved to ACA through ICHA from Group." "Similarly, a majority indicate the move has gone better than expected." Not my words, direct quotes from the brief. The change is happening. Are you a some are or some are not? The fourth quarter is right around the corner, and ACA 2024 season will be here before you know it! ⏰ ⏰ ⏰ It was right around this time last year that the IRS published the 2024 threshold percentage, so be on the lookout for the 2025 amount in the coming months (we'll keep you posted!) The ACA threshold is the percentage an employer uses to determine premium affordability. The employee's portion of the premium cannot exceed 8.39% of their income, using one of the three available affordability calculations. Over the next few weeks, I'll be posting refreshers about affordability and other ACA basics here and on the All Things ACA blog! We expect the IRS to increase their frequency and number since they announced that there would be no more leniency a couple of years ago.... so be on the lookout, it's not one you want to toss in the waste basket. 𝗗𝗼 𝘆𝗼𝘂 𝗻𝗲𝗲𝗱 𝘁𝗼 𝗳𝗶𝗹𝗲 𝗳𝗼𝗿 𝗮 𝗽𝗿𝗲𝘃𝗶𝗼𝘂𝘀 𝗔𝗖𝗔 𝘆𝗲𝗮𝗿?... many employers missed filing when they had to without realizing it. Proactively filing, even if late, may avoid the IRS even printing the Penalty Letter, if they have not done so yet. 𝗔𝗿𝗲 𝘆𝗼𝘂 𝗮𝘄𝗮𝗿𝗲 𝘁𝗵𝗮𝘁 𝗯𝗮𝘀𝗲𝗱 𝗼𝗻 𝗻𝗲𝘄 𝘁𝗵𝗲 𝗗𝗢𝗟 𝗜𝗻𝗱𝗲𝗽𝗲𝗻𝗱𝗲𝗻𝘁 𝗖𝗼𝗻𝘁𝗿𝗮𝗰𝘁𝗼𝗿 𝗙𝗶𝗻𝗮𝗹 𝗥𝘂𝗹𝗲 𝗺𝗮𝗻𝘆 𝗼𝗳 𝘆𝗼𝘂𝗿 𝗰𝗼𝗻𝘁𝗿𝗮𝗰𝘁𝗼𝗿𝘀 𝗺𝗮𝘆 𝗻𝗼𝘄 𝗯𝗲 𝘆𝗼𝘂𝗿 𝗲𝗺𝗽𝗹𝗼𝘆𝗲𝗲𝘀?... making your company an ALE, having to offer them coverage and having to do a 2024 ACA Filing. 𝗗𝗶𝗱 𝘆𝗼𝘂 𝗸𝗻𝗼𝘄 𝘁𝗵𝗮𝘁 𝘁𝗵𝗲 𝗔𝗳𝗳𝗼𝗿𝗱𝗮𝗯𝗶𝗹𝗶𝘁𝘆 𝗣𝗲𝗿𝗰𝗲𝗻𝘁𝗮𝗴𝗲 𝗱𝗿𝗼𝗽𝗽𝗲𝗱 𝗳𝗿𝗼𝗺 𝟵.𝟭𝟮% 𝘁𝗼 𝟴.𝟯𝟵%?... This means that employers will be paying a higher percentage of the premium, which is compounded by higher rates. But more critical is that even if you keep your employee contribution amounts the same for 2024 plans, they may now be unaffordable and non-compliant! 📢 What Does a Trump Administration Mean for ACA Compliance? Despite attempts to do so during his first term, we do not expect a push to repeal the healthcare law due to its widespread use and popularity — including high enrollment in Republican districts. While there could be a change in the value of Premium Tax Credits utilized under the ACA, we anticipate the key protections and compliance aspects included in the ACA Employer Mandate to remain intact.
