The four Model Clauses – on Highly Expedited Arbitration, on Adjudication, on Technical Advisers and on Confidentiality – are designed as a resource for businesses and practitioners engaging in international dispute resolution, especially when speed and technical expertise are crucial factors. On 5 June 2024 during London International Disputes Week (LIDW), CIArb London Branch, Freeths and Gatehouse Chambers hosted an informative panel discussion on lawyers (mis)behaviour in international arbitration with Dr Crina Baltag, FCIArb, Frederico Singarajah, FCIArb and Mr. Justice Robin Knowles CBE, with the session moderated by Paul Kinninmont FCIArb. Interesting to note the following highlights: Dr Crina Baltag, FCIArb discussed challenges and realities with different standards (i.e. guidelines or rules), ethics and culture which affect disclosure, communication, fact witness evidence and expert evidence in international arbitration. She emphasised the importance to look at them holistically. Mr. Justice Robin Knowles CBE advised, "When parties choose arbitration, they are really choosing a process for a fair decision. It isn't about arbitration going wrong, it's about collectively making it a success. We can make even more success of arbitration by working together appropriately. It is a shared responsibility to ensure the fair process and the reasoned and enforceable award". Frederico Singarajah, FCIArb discussed the tension between the duty to the tribunal and the duty to represent clients in the context of disclosing adverse documents and lawyers' influence on experts' opinion. Reflecting on an insightful experience at the London International Disputes Week! I had the privilege of attending a captivating panel discussion on "𝐅𝐢𝐠𝐡𝐭𝐢𝐧𝐠 𝐚𝐧 𝐀𝐫𝐛𝐢𝐭𝐫𝐚𝐭𝐢𝐨𝐧: 𝐎𝐩𝐭𝐢𝐦𝐢𝐬𝐢𝐧𝐠 𝐘𝐨𝐮𝐫 𝐂𝐡𝐚𝐧𝐜𝐞𝐬 𝐨𝐟 𝐒𝐮𝐜𝐜𝐞𝐬𝐬" co-hosted by Travers Smith and Essex Court Chambers. The event featured leading experts-Huw Jenkin, Adam Short, Emily Wood KC, David Walsh and Peter Webster, who shared strategies, war stories, and best practices for navigating arbitration proceedings. Key takeaways for me included: i. Critical and active management of arbitration: The panel emphasised the importance of proactive case management, from setting clear objectives to continuously monitoring progress. Staying ahead and anticipating potential obstacles is crucial for achieving a favourable outcome. ii. Early/ summary determination issues: The panel delved into the complexities surrounding early or summary determinations. Relying on the statistical analysis, the speakers provided valuable strategies on when and how to pursue these options effectively to save time and resources. The discussion also briefly addressed the due process paranoia plaguing the arbitration process, and also the transformative role of technology in modern arbitration. The session underscored that success in arbitration is not just about knowing the law but also mastering the art of strategy, management, and the adept use of resources and technology. A big thank you to the organisers and speakers for an enriching and thought-provoking discussion. The Explanatory Notes provide a detailed description of the objectives of the specific SPEDR Model Clauses, including their associated risks, if any, and alternative approaches, where applicable. The SPEDR Model Clauses and their Explanatory Notes will be published soon, allowing parties to select the Model Clauses best suited to their needs. The UNCITRAL Model Clauses on Specialized Express Dispute Resolution (the “SPEDR Model Clauses”), adopted during the 57th session of the United Nations Commission on International Trade Law in New York, provide customized solutions designed to be adapted and adjusted to suit the particular circumstances and preferences of the parties.
