In a few days, the removal of electoral propaganda in Mexico will begin. Unfortunately, the same will happen with electoral promises. I write today in EL Universal C.P.N. about the worrying dilemma in which we find ourselves in many countries where the lack of accountability mechanisms makes populist and demagogic speeches gain strength and erode democracy. And why the case of Trump's conviction shows us that we need independent institutions to confront these electoral facades that often have behind them schemes of diversion of resources, fraud, and illegal financing to hide their true political agendas. As a business litigator and firm believer in the principles of election integrity and transparency, I find it crucial to address how legal strategies are employed during election cycles. The recent interview discussing preventive lawsuits and allegations of fraud before the ballots are even counted underscores the importance of balancing vigilance with trust in our electoral processes. Elections are a cornerstone of our democracy, and their legitimacy hinges on both their integrity and the public’s perception of fairness. While proactive legal measures can serve to protect the process, they should also reinforce confidence in our systems rather than sow doubt. Transparency, accountability, and the rule of law must guide us, ensuring that every vote counts and is counted fairly. How do we best balance these principles in today’s politically charged climate? Your insights are welcome. #Election #Law #Legal #Lawyers #Election2024 #Politics

🟢 ARTICLE | Interested in exploring the complexities of Mexico’s debate on congressional overrepresentation? Luis De La Calle’s article “La sobrerrepresentación no es un asunto numérico ni de cuotas, quizá de gobierno” examines the potential abuse of the Morena coalition to gain overrepresentation in Congress while questioning whether it is solely electoral or also governmental. Such a situation would influence the allocation of deputies and the ability to amend the Constitution without negotiating with other political forces. 👉 https://lnkd.in/gAJ2sRQA #Mexico #TransitionPeriod 🇲🇽 #Overrepresentation #Congress #ChecksAndBalances #Morena

#Mexico🇲🇽is on the brink of its largest-ever election day, with significant stakes at play. However, amidst the anticipation, there are concerns raised by opposition forces regarding President Andrés Manuel López Obrador's intentions should his allies emerge victorious. The fear is that a victory for his allies could potentially lead to a deepening of authoritarian rule, raising alarms about the future trajectory of Mexico's democracy. Adding to the complexity of the situation is the exploitation of electoral competition by criminal groups. These groups see elections as an opportunity to further their agendas, whether it be through securing impunity for their illicit activities or gaining influence over political processes. This exploitation poses a serious threat to the integrity of the electoral process and undermines the democratic principles that elections are meant to uphold. The significance of these issues cannot be overstated. Electoral violence and illicit influence in Mexico have been on the rise in recent years, and the upcoming elections are predicted to be critical in determining the country's political landscape moving forward. The polarization of Mexican politics and the weakness of its political parties only exacerbate the situation.

We're proud to announce that our partner, Joseph G. Feldstein-Del Valle, Esq., was recently interviewed by Microjuris.com to provide expert commentary on President Biden's proposals to reform the US Supreme Court and modify immunity for former presidents. Joe, who teaches federal procedure, federal civil rights, litigation, and correctional law at the Escuela de Derecho -Pontificia Universidad Católica de Puerto Rico, shared his insights on these significant proposals: "These are unexpected measures. During a 'lame duck president' period, appointments or decisions of such importance are unusual. Two of these proposals require amending the Constitution, a difficult and deliberate process. It's a solid structure," Joseph commented. The article discusses the proposed term limits for Supreme Court justices, the elimination of immunity for ex-presidents, and the creation of an ethics code for the federal Supreme Court. At Feldstein, Soto-Acabá LLC, we're committed to staying at the forefront of legal developments and contributing to important discussions in our field. We invite you to read the full article on Microjuris.com for a deeper understanding of these proposals and their potential impacts on our legal system. https://wp.me/p1yTAH-IAF #LegalExpertise #ConstitutionalLaw #SupremeCourtReform #Microjuris

The Kremlin, focused on "encouraging independence" through cyberattacks 📍 "They are political parties, institutions and States." What is behind the biggest cyberattacks, the great hoaxes that call into question the credibility of democratic systems, are not particular individuals, because they "do not have a sufficient network of influence." This is stated by Juan Miguel Velasco, CEO of the Spanish 🇪🇸 firm Aiuken Cybersecurity, who, far from generalizing, points to a single country as the real threat: Russian 🇷🇺. In the next three months, the Basque, Catalan and European 🇪🇺 elections will examine the Spanish, and community, capacity to combat the threat of disinformation, a danger that will materialize differently before each electoral summons 🗳️ 📍 According to Velasco, the Kremlin 🪆 will try to influence the result of the European elections by promoting candidates "who are anti-war in Ukraine or more pro-Russian," spreading messages 💬 that question the integrity of the West and treat them as the most reliable alternative. In the face of the Basque and Catalan elections, the goal of Russian cyberattackers ☠️ will be to "encourage segregation and independence," with an eye on weakening Europe and "diverting attention from the war from Ukraine." 📍 "The little gasoline ⛽️ that is put on these fires, there is a lot of internal conflict in the countries and this leads to an uncertainty that makes people 🫣 not think beyond their borders," Velasco reasons. This is not new, since the Russian injection in the process and its link with the Catalan independence movement are already being investigated 🕵️♂️ in the European Parliament. Disinformation campaigns take center stage during the pre-election period, while the day of the elections reaches the peak of cyberattacks 🏴☠️ Thanks 🙏🏼 to Paloma H. "I write these lines to you, with my thumb stained with indelible ink, with mixed feelings. Happiness for having chosen a woman and fear that it will be you.... Today the militants of your movement celebrate, but millions do not. I do not join in the applause. Elections also empower leaders who seek to destroy democracy, and I worry that you are one of them. Being a woman does not mean being a democrat and I question whether you are...I believe that there can be no good government without counterweights, and you have contributed to attacking them...There can be no good government without autonomous bodies and you have supported their submission [to the executive branch]. There can be no good government without institutions that can carry out the basic tasks of the state, and you have endorsed institutional carnage. And perhaps the most aberrant thing: There can be no democracy accompanied by untamed militarization, without civilian controls." https://lnkd.in/e4PfvtCu
