Today we had our Webinar together with Leyton regarding “IP Protection and Funding Opportunities for Innovations”. All too often, innovative companies come to us for legal advice when it is already too late, and, as we say in German, when “das Kind bereits im Brunnen liegt” (the child has already fallen into the well, i.e. when the damage has already been done). The IP world has unfortunately become more complicated over the last years, and it is therefore all the more important, that one starts a R&D project with the right grounding, in particular with clear and fair contracts and the appropriate allocation and protection of the respective developments results. There is often the misconception that, particularly at the beginning of a project, there is neither time nor money to set up the necessary legal documents. Any mistakes made in the early phase will nearly always haunt you in the future and may render a successful product launch or possible sale of the technology to an investor impossible. For me as a lawyer, it is always truly sad to witness how very successful developments, which could have improved life, collapse at the end due to legal oversights.   Many thanks also to my co-speaker, Dr. Saskia Graf for her very insightful and informative presentation. Many thanks to you and your enriching presentation, Dr. Marco Stief, LL.M. (University of Chicago)! Most public funding programms require a clear demonstration of freedom to operate and how IP is handled already during the application phase, so a few months before the project has even started. Collaborative projects will not receive funding without a signed contract regulating IPR between all partners. This emphasizes how important IP protection is for a succesfull R&D project - also from the perspective of public financing.
