I hope that other #advancedmanufacturing colleagues will remember that playing offense includes speaking up to influence policy decisions, and not just bracing for whatever may happen. The artcle recounts the chaos Paul experienced as CEO of Carey Manufacturing, and that we all confronted during the last experiment with #tariffs which didn’t just cause significant price increases but a massive drop in #productivity as we all scrambled to reassess our #supplychains, scramble our management teams to requote projects daily, and deploy #qualitymanagement auditors around the globe to ensure compliance with #Connecticut’s highest level #aerospace #AS9100 #medical #ISO13485 and #automotive #IATF16949 standards. Many thanks to Donald Allan Jr., CEO of Stanley Black & Decker, Inc., who states it clearly; “Obviously, coming out of the gate, there would be price increases associated with tariffs that we put into the market,” and explains that manufacturing now done in China would be moved to other parts of Asia or Mexico - not the USA. The day after election day, I was asked how the election would impact CT manufacturing companies. While it is too soon to tell, we need to be prepared for many different scenarios, both with a potentially positive or negative impact on our economy. We have been dealt a hand of cards. We don't know what the cards are. But I do know we will play our hand to win, and in Connecticut, we win. The future is always uncertain. In 2021, President Biden issued an executive order, which specifically encouraged agencies to mount their efforts in cracking down repair restraints. The order has accorded the right-to-repair movements with substantial legislative momentum—as of August 2023, at least 25 states are actively considering right-to-repair legislations. Corporations have also begun to announce their right-to-repair initiatives. Notably, Apple recently declared that it would honor California’s new repair provisions and would be making available all information and tools for consumers and repair shops to fix its products nationwide. Happening concurrently with the executive, legislative, and business-initiated right-to-repair moves are the judicial ones. In “Opening the Door to Right-to Repair: Deere & Co. and Its Implications,” Kira (Yuxin) Liu (’25) parses the most recent right-to-repair opinion. Analyzing the court’s reasoning, this article argues that Deere & Co. demonstrates the judiciary’s cooperative role in pushing forward the right-to-repair movement, manifested in its willingness to get around two barriers faced by right-to-repair litigants: the standing barrier as posed by Illinois Brick and the substantive barrier as posed by the general jurisprudence of limiting aftermarket claims since Kodak. While some uncertainties of the reasonings are to be further spelled out by future opinions, Deere & Co is arguably a big win for right-to-repair litigants in making progress within the traditional antitrust framework. 📢 New Product Safety and Metrology Bill 📢 In the King’s Speech in UK Parliament last week, it was announced the Government will be introducing a new Product Safety and Metrology Bill. One of the intentions of this Bill is to allow for closer alignment between EU and UK Regulations on product safety, weights and measures following Brexit. Most of the product safety framework in the UK is derived from EU law, and the new Bill aims to change that by enabling the UK to make a sovereign choice to either mirror or diverge from updated EU rules, to maintain high product safety while supporting businesses and growth.
