The number of people angry at broadcast stations because the GOP decided to run a candidate/s who use the statute to air vile, racist, bigoted, grotesque imagery is so depressing. Candidate ads are a revenue LOSS for local broadcast. There is NO 1A protection for broadcast editorial discretion when it comes to legally qualified candidates accessing the licensed spectrum. There are arguments for and against § 315. But the depths of exploitation of it know no bounds. That a licensee is forced to use their own inventory to add disclaimers on the front or back ends speaks volumes. And… if our hands are going to be tied by a statute that overrides indecency/safe harbor regs, then perhaps indecency/safe harbor serve no real purpose anymore if they ever really did. Because clearly the message we are sending is that protected speech can be compelled or censored arbitrarily. Chilling indeed. https://lnkd.in/eJfmCgH6
