CONFERENCE ON THE CULTURAL CORPORATION Today at 2:30 PM I will give a presentation at the University of Verona about the impact of the rules of the Italian Code of Cultural Goods on the activity of corporations operating in the cultural fields in Italy (but not only). In fact, most of these rules tend to be completely overlooked by corporations, but are more and more strictly enforced by the Ministry of Culture, that recently has been even trying to pretend that they apply abroad too (the Ravensburger case being a good example, where the German court judging on the same matter said straightforwardly that the application of Italian law abroad was simply countrary to international principles of law). I had the pleasure of delivering a long talk on what mediation is at the IAPL Colloquium. My key messages were * Mediation is an ambiguous term. It can refer to facilitative, interest-based processes alone, be used as a synonym for ADR, or anything in between. Therefore, it's imperative to define mediation, especially in comparative contexts. * The assumptions, beliefs, ideas and policies underpinning mediation vary across contexts and countries and have tangible implications for how mediation is understood, organised, practised and regulated. Interrogating and explaining these assumptions and their manifestations is paramount. * Mediation research questions many of the tenets of mediation in many contexts. Disputants' needs and wishes vary depending on the context. * In light of the Scandinavian experience, claims that disputants will not use mediation unless mandated or strongly incentivised to do so is not correct. Mediation must just be designed and implemented in a way that renders it attractive. One should meditate because one wants to, not because one has to.
The 2024 IAPL Colloquium devoted to "Procedural Law in a Multicultural Context" has come to an end: it has been three days of inspiring speeches, networking activities, and exchanging ideas among the wonderful IAPL family.
