On the 10th day of Christmas, 3B gave to me: 10 lords a leaping and a horseplay allegation! SCENARIO: Andy is known for playing pranks on employees at the office. He has been asked to stop several times. One day a coworker decides to get him back by pulling a chair out from under him. Andy falls and injures his tailbone. The employer thinks this is horseplay because “Andy started it”. What do you think? TIPS: 1. Some jurisdictions have affirmative defenses for horseplay. Check yours for applicability. 2. THE PUPIL! BLOG 5 Annulments, horses, hotel lobbies, Ubers, and expectations… As I’ve already shared my pupil supervisor got a bankruptcy annulled on the grounds it should never have been made. A Post Office Horizon case it took 11 years to get justice. That morning 2 horses escaped and ran through London, past the Royal Courts of Justice where the decision was made. I couldn’t help but think of the metaphoric similarities. Those horses filled with excitement, determination, energy and strength galloped through London. They didn’t know when their journey would end, or indeed how, but the belief it was one worth taking was what powered their first setting off. However, as they went they incurred injury, became spooked, caused injury to others and eventually were caught and brought back to a safe place to recouperate. The pursuit of justice often the same. The parties, the lawyers, the judges, society and the communities all represented in the analogy of the horses. I’ve been on the road plenty. Consciously filling my free time with rewards. For me a reward is having the little something extra. A drink? Let’s have it in a nice hotel (I love a good lobby), an Uber? Aaaahh go on book the exec, why? …Nope it isn’t snobbery, or ostentatiousness. They are markers for me, as much as rewards. Growing up in N. Ireland during ‘The Troubles’ there was not a lot of luxury or ‘extras’ around! Dreams of being a barrister in England - LONDON!! As ridiculous as hoping to pick up the slack for Santa as his replacement sleigh driver. Rewards are supposed to be the something that excedes your needs, that goes further than expectations, that gives you a feeling of having achieved. Working hard and seeing results of the hard work a reward no doubt! Having the little extras are the markers that you deserve the rewards! In my media work these things often became the norm! The highest end luxuries expensed and provided as readily as a bottle of water or meal deal. However, often, the balance in pay, conditions, and other factors nowhere near the same. The luxuries were not rewards but often extensions of the providers image that could be seen by others, whilst the work, conditions, and the remuneration were often unseen. As we all progress through our careers we do so with our own set of expectations. When your expectations are met, that means you are on track. When your expectations are exceeded then you are doing better than you thought. This is a reminder to take a look at your expectations, know your worth, reward yourself when appropriate, more importantly- REFLECT! Look at what YOU can do to improve your input for your output. I’m meeting more people in chambers, and outside of chambers in court etc. my expectations repeatedly exceeded by the kindness and genuine support! The myths about the bar daily exposed as fantasy… However, on reflection I have work to do! There are very high standards to be met, rightfully so! Gallop on I shall!

And in other news… you don’t have to be a billionaire to get in a dog fight. These pups didn’t bite anyone. They allegedly “harassed” their neighbors and were “aggressive”. The dog owners are being sued. Yeah, you can get sued for a lot of reasons - legally liable or not, you’ll be happy to have your personal liability coverage step up to provide legal defense.
