In my recent interview, Lawyer Monthly asked “What do you consider the most significant challenges in employment law today, especially in an evolving, post-Covid 19 workforce?” I answered: “Obviously, COVID-19 really changed how people feel about work. In both, employers and employees learned a lot about how work can be more flexible and accommodating to peoples’ lives. This is a challenge for employers because on the one hand, having everybody in one place doing the work together really lends to the team building aspect of getting the job done. And whatever industry you’re in, that’s a positive factor. 📚 What is the definition of an employee under the Fair Work Act 2009 (Cth)? According to Section 15 of the Act, the term employee refers to someone engaged in work under the ordinary meaning of the term. But it’s important to break this down: 1️⃣ An employee includes anyone who is usually considered an employee. This covers individuals who are regularly employed in a typical employer-employee relationship. 2️⃣ However, it does NOT include people on vocational placements. Vocational placements are designed to provide practical training for students, so they are exempt from being classified as employees under the Act. Similarly, an employer is anyone who usually takes on the role of an employer, managing and overseeing employees in their usual capacity. 💡 Keep in mind that this is just the basic definition. Appreciate the incredibly informative webinar provided by Daniel Lublin of Whitten Lublin to my Executives in Transition group. He spoke about Executive Employment Contracts. Employment law is always changing. What is most important, however, is that there are nuances to employment contracts that apply uniquely to executives. If you have found that employment contracts seem super detailed as never before, that is a new thing. Daniel pointed out that almost all employment contracts, post-Covid, are very comprehensive. He also indicated that executives are held to a higher standard by courts so the expectation is that you know what you are signing. We talked about how important jurisdictional issues are in employment contracts; it can really impact your severance. He also suggested additional clauses that protect you in your contract. The bottom line is that you should never, ever sign an employment contract without very good legal advice. The lawyer should not be a general practice lawyer but an employment lawyer. Buy an hour of their time- it's the best money you'll ever spend. Daniel is top-notch. I want to thank Daniel and Maria Melo-Boone for putting this together for us. Why do I act for both employees and employers? My personal perspective as an employment lawyer. For years, I've had the privilege of advising and representing both employers and employees - not in the same matter, of course! This unique vantage point isn't just happenstance – it's the foundation of my approach to practicing employment law. Imagine having a panoramic view of a complex landscape.  That's what it's like seeing issues through the lens of both sides. It helps to analyse challenges with greater depth, considering not just legal nuances but also the human and organisational dynamics at play. This dual perspective also fosters empathy. I've walked beside both types of party - experiencing their anxieties, priorities, and motivations firsthand. This helps to anticipate each move the other side might nmake next. It also helps to build bridges, not walls, even when tensions and conflict are high. In the face of conflict, I don't just hear arguments – I actively listen. Deciphering the "why" behind each position helps navigate even the most intricate disputes and craft solutions that are not merely acceptable, but beneficial for everyone involved. Some might view this experience as straddling a tightrope. I prefer to see it as holding the key to unlocking a more nuanced, effective approach to my employment law practice. So, if you're facing a workplace challenge, know this. My team and I are not here to simply pick a side. A few articles ago we were talking about the legal procedures to follow if you are being bullied in the workplace, please note that most of these steps also apply if you are facing any form of bullying in any other environment including home, fundamentally do not remain silent. Now you have allowed your workplace to carry out its own due diligence and you are still not happy with the outcome you received, IT IS NOT OVER, you can now escalate the case, and I emphasize CASE because it has now become a legal matter which may not just be against the bully but also your employers if you have legitimate reasons for feeling silenced. It is at this stage you should consider getting an employment lawyer. An employment lawyer will do a copious amount of things when acting on your behalf but here are 4 primary aspects of their role: 1.Advocate for you At this point in your grievance, you will most likely be feeling emotionally fatigued and drained, as a result of this you may begin to lose some parts of your experience of being bullied, the sequence of events can also become blurred and confusing, so it is important that you find someone who can represent you both professionally and legally. 2.Knowledge The employment lawyer will be an expert in the intricate details of employment law and examining organisations Standard Operating Procedures (SOP) to identify if the organisation has upheld its quality. 3.Employment Rights Give comprehensive advise on your workplace rights which you might not have been aware of in relation to claims, compensation, settlements etc. 4.Resolving Disputes The employment lawyer will step in the gap between you and your employer to FIRSTLY try and resolve the conflict by whatever means necessary. As you get closer to the end of your grievance/case, you will have to begin to think about what best and reasonable outcome do you want and where do you go from there.
