Hello California business owners, and, whoever might need to access their CA State Disability in 2025 - the rates to employers are going up (ever so slightly), and the percentages of pay-out to the employees are changing as well. Thank you to the original poster of the information. CA to increase short term disability (SDI) pay starting Jan 1st, 2025 Benefit Increase: Previously SDI benefit provided around 60-70% of a workers wages depending on income level. This is meant to increase to 70-90%, with lower-wage workers receiving a higher percentage of compensation. Wage limit eliminated: The new law eliminates the current wage limit of $145,600, so now all employee wages, even those above this amount, will be subject to SDI contributions. Impact and Action: These changes could have an impact on employer-sponsored and voluntary group short-term disability plans in place. It is important that companies understand and potentially adjust percentages of their current programs and/or look at other options for highly compensated employees.

New Jersey Employers: Did you have employees on disability leave in 2024? If your employee received NJ Temporary Disability Insurance benefits (TDI) you will need download and submit a copy of this information to your payroll provider. Year-end statements for Temporary Disability Insurance benefits are available online for employers to download in January for the preceding calendar year. Only a portion of the Temporary Disability Insurance benefits paid are taxable by the federal government (they are not taxed by the State of New Jersey). They are considered third-party sick pay or other wages. It is the employer's responsibility to report the taxable information on your employee’s W-2. AZ Business Owners, the time is upon you! PFML (Paid Family Medical Leave) is already mandated in 15 states and counting! There will be much more continued media coverage on PFML, as it is something “new” and exciting and employees/voters have been asking for paid family medical leave to be mandated for decades. If you do not already have a plan in place, or have not talked about what these programs will look like for your business in the coming 1, 5 or 10 years, then I would seriously suggest having that conversation now rather than later. It is very common, unfortunately, for businesses small and large to be out of compliance. I know of businesses that are brokered by “cash grab” brokerages currently headquartered in Phoenix with employees in other states that do not have any PFML plan in place and are most likely on the verge of an audit without knowing it. If you have yet to have this conversation, or your broker has not made it their responsibility to make sure you are staying in compliance, you should seriously start putting your business before your broker relationships 🫱🏽🫲🏾 My inbox is always open!

Third Circuit Affirms Standard Insurance Company’s Decision to Terminate Long-Term Disability Benefits under the “Any Occupation” Standard In Brown v. Covestro LLC Welfare Benefits Plan, et al., No. 24-1043, 2024 WL 4751199 (3d Cir. Nov. 12, 2024), Plaintiff challenged the termination of his long-term disability benefits after Standard Insurance Company, his employer’s disability insurance company, determined that he was no longer totally disabled. Plaintiff claimed disability due to multiple diagnoses relating to back pain. The district court adopted the Magistrate Judge’s determination that “the denial of benefits did not constitute an abuse of discretion; that the plan administrator substantially complied with the applicable ERISA standards; and that to the extent the administrator erred, the denial was supported by substantial evidence, and remand would be futile.” Plaintiff appealed and in a non-precedential opinion, the Third Circuit affirmed.
