This came up recently with a retainer client. They were delivering an IT and telecoms solution for a client and had various milestones that they had to meet at different stages through the process. For various reasons largely as a result of third parties (including BT might I add) they had slipped in terms of being able to meet a couple of the milestone provisions contained in the contract. The starting point is always to consider the contract - we looked to vary the terms in light of the difficulties encountered. The contract required any variation to be in writing and agreed bewteeen the parties so we drafted a document which sought to vary the original milestones and eventually this was signed by the customer. #sme #law #help
My contract contains key milestone and I’m not going to be able to meet them what do I do? Essentially you will need to look at your contract - check to see if the contract allows for variations and comply with any contractual provisions in terms of varying the terms and if this needs to be done in writing make sure you comply and evidence what was agreed in writing each time. It’s always best to plan ahead and if there needs to be changes made you can deal with the issue in a timely manner beforehand. #business #law #lawyer
