While super generally doesn’t need to be paid to independent contractors, there are exceptions. If the contract mainly revolves around their labor, you may be required to pay super, regardless of whether they have an ABN or how much they earn. To determine if superannuation applies, consider: 📍 Is the contractor performing work mainly based on their labor (physical or mental)? 📍 Do you have control over how, when, or where their work is performed? 📍 Are they paid based on time worked rather than a result-based contract? 📍 Could they be seen as operating more like an employee for your business under the Super Guarantee rules? When setting up a brand-new business and hiring your first employee, at a minimum: 1) don't bring that person on as an independent contractor with the intention of making them an employee down the road (chances are that is a misclassification); 2) have your accountant set up an unemployment insurance account in the state where the business is operating/employee is working; 3) have your insurance broker get workers' comp insurance, and any state-required other insurances (such as short-term disability or paid family leave insurance); 4) set up the ability to do payroll; 5) partner with management-side employment lawyer to be sure you satisfy new hire obligations in the state where the employee is working: 6) determine what benefits are required (e.g , paid sick leave), and what are optional (e.g., paid holidays and vacation), and establish what you want to do; 7) outline job duties and expectations for the new hire and communicate these; 8) produce, prosper, grow!
