Congress is revising legislation related to hemp-derived products as part of the 2024 Farm Bill reauthorization and the Agriculture-FDA Appropriations bill. The House proposes redefining "hemp" to include only naturally occurring, non-intoxicating cannabinoids, excluding those with quantifiable amounts of Total THC. This change aims to address issues resulting from the 2018 Farm Bill, which inadvertently led to a thriving market for hemp-derived cannabinoids, some of which contain THC levels exceeding the intended limit. The Senate version of the funding bill currently lacks hemp-related provisions, but negotiations between the House and Senate may result in a compromise before final passage. The changes could take effect as early as this fall, potentially preceding the DEA's final regulation on marijuana rescheduling.

Last fall, we tested over 200 cannabis products, examining three aspects: pesticide contamination, THC potency accuracy, and the presence of (illegal) chemically synthesized THC. Our investigation covered a sample size four times larger than the LA Times’, encompassing the top 70 brands in the market. The good news is that 84 percent of our tested samples met California’s stringent pesticide standards. The bad news is that 16 percent exceeded allowable pesticide limits and should never have been approved for sale by the testing lab. There was a lot of discussion about intoxicating hemp products last night at the NJCBA event in Edison. Today this discussion was in my mailbox: https://lnkd.in/eM4_G8cD And also this one: https://lnkd.in/epcPTueU Point is that there is action underway in many states to deal with this as well as nationally. Today's NJCBA email to members discusses NJ's approach. I've also had discussion with our Laboratory Testing Committee on concerns they have with the current draft legislation, specifically the measurement issues of the change to a total THC measure, instead of the current approach in the NJ cannabis program. If you are involved in hemp and CBD product manufacturing, even if you are not producing and using delta 8 THC or other synthetic cannabinoids, you should get familiar with the pending legislation and weigh in now .. the NJ bill to regulate intoxicating hemp products is moving relatively fast!

Total delta 9 THC is delta 9 THC AND delta 9 THCA Texas Administrative Code TITLE 4 AGRICULTURE PART 1 TEXAS DEPARTMENT OF AGRICULTURE CHAPTER 24 HEMP PROGRAM SUBCHAPTER E TESTING RULE §24.26 Methods for Testing (a) Laboratories shall use appropriate, validated methods and procedures for all testing activities and evaluate the measurement of uncertainty. (b) At a minimum, analytical testing of samples for delta-9 tetrahydrocannabinol concentration levels must use post-decarboxylation or other similarly reliable methods approved by the Department. (c) The testing methodology must consider the potential conversion of delta-9 tetrahydrocannabinolic acid (THCA) in hemp into delta-9 tetrahydrocannabinol (THC) and the test result reflect the total available THC derived from the sum of the THC and THC-A content. Testing methodologies meeting these requirements include, but are not limited to, gas or liquid chromatography with detection. (d) Alternative testing protocols will be considered by the Department if they are comparable and similarly reliable to the baseline established under the Department program. Alternative testing protocols must be requested of the Department in writing and approved in writing by the Department, provided they meet the requirements of this subchapter.
