VTA Delegation Strengthens Ties with Shanghai International Economic & Trade Arbitration Commission 🌟 Following the productive meeting between the President Pham Xuan Sang of the Vietnam Traders Arbitration Centre (VTA) and representatives from the Shanghai International Economic and Trade Arbitration Commission (Shanghai International Arbitration Center (SHIAC)) in June, a delegation led by Ms. Phuong Dang (Paige), Vice President of VTA, including Mr. Tian Jian, Director of Cooperation Development (for Greater China), and Mr. Roger Ni, Arbitrator, made a significant visit to the SHIAC on November 25th 🌻. During this meeting, VTA and SHIAC delved deeper into potential cooperation opportunities. Both organizations expressed a strong commitment to exchanging more information and delegations, aiming to foster a robust partnership. In addition to discussing cooperation, VTA took the opportunity to share insights into Vietnam's commercial landscape. The delegation highlighted VTA's unique advantages and strengths compared to other Vietnamese and regional arbitration centers, emphasizing its strategic position and expertise in the region 💫. This visit marks another milestone in VTA's ongoing efforts to build international partnerships and enhance its role in the global arbitration community. 💠 Mrs. Gulnur Nurkeyeva, Managing Partner and Head of China office at GRATA International, delivered a speech at the conference “Leading International #DisputeResolution in the #MiddleCorridor”. The event was held on November 19, 2024, in Astana, organized by the Astana International Financial Center Court (#AIFC Court), the International Arbitration Center (#IAC) and the #China International Economic and Trade Arbitration Commission (#CIETAC). In her speech, Gulnur Nurkeeva addressed the enforcement of arbitral awards in the Republic of Kazakhstan. Participants, including representatives of the IAC and the CIETAC management, discussed key aspects of the arbitration systems of Republic of Kazakhstan and the People's Republic of China, upcoming legislative reforms, the IAC and the CIETAC regulations, and the enforcement of arbitral awards in both jurisdictions. 𝐈𝐭'𝐬 𝐍𝐨𝐭 𝐉𝐮𝐬𝐭 𝐭𝐡𝐞 𝐒𝐭𝐚𝐭𝐞 𝐂𝐨𝐮𝐫𝐭𝐬 Having attended numerous conferences focused on investments in Central Asia, I've noticed that many investors are uncertain about what to expect regarding dispute resolution. They often assume the legal terrain is unwelcome and unfamiliar, and that dispute resolution is limited to state courts. However, the region has much more to offer. In recent years, Central Asia has experienced significant growth in foreign investment, becoming increasingly attractive to global investors. This transformation has turned the region into a hub for international trade and investment. According to the ICC Report for 2023, Central Asia accounted for approximately 12% of the ICC's caseload, up from about 10% for the combined CEE and CA regions in 2022. Responding to this transformation, local arbitration institutions are starting to play a larger role in the regional arbitration arena. Two local institutions are particularly noteworthy: the Tashkent International Arbitration Centre and the International Arbitration Centre at the Astana International Financial Centre. In this piece, Craig Tevendale, Olga Dementyeva, Derek Lee, Siddhant Ahuja and I discuss what these institutions have to offer. You will see that they closely adhere to international best practices with their respective rules and, in some respects, go even further. Their modern frameworks, combined with recent pro-arbitration developments in Kazakhstan and Uzbekistan, are likely to provide significant reassurance to investors, fostering a more stable and conducive environment for foreign investments. Thanks to Rede Chambers and Leon Guo for inviting me to join this panel. In addition to discussing the advantages of Hong Kong as a seat, I ventured to raise a few concerns over two decisions of recent years, and clarified a few issues relating to the application of interim measures in Mainland China in support of Hong Kong seated arbitration: 1. Though Mainland China courts do not necessarily assess the merits of the case, one should bear in mind that the court practice are quite diversed; 2. Asset preservation measures are not "world-wide" and the applicant has to provide information on assets to be seized or frozen; 3. The bar for the applicants to bear civil liabilities for wrongful applications are quite high, and requires a degree of bad faith; 4. The insurance policies applicant secured as fortification are liability insurances and thus the insurance companies usually have no recourse against the applicants - so the scrutiny by them might be quite substantive.
