In Switzerland, new rules will apply to international successions from the beginning of 2025. During its session on 26 June 2024, the Federal Council set 1 January 2025 as the effective date for the amendment of the Federal Act on Private International Law. By reducing the risk of jurisdictional conflicts between Swiss and foreign authorities, this revision strengthens legal certainty for citizens who wish to settle their estate. The new PRC Foreign State Immunity Law has expanded the scope to sue and enforce against foreign states in Hong Kong. Hong Kong is more closely aligned with international practice in key areas as a result. A form of "restrictive" immunity replaced the previous "absolute" approach with effect from 1 January 2024. Yesterday, the European Commission published its annual Rule of Law Report. This report evaluates the state of the rule of law in the EU member states. The report focuses on the independence of the judiciary, the fight against corruption, media pluralism, and institutional issues.🇪🇺 🏛️📜⚖️🎓 We are pleased and honored that the Commission met with representatives of AmCham Slovakia during the preparatory consultations and worked with materials from the Rule of Law Initiative (Iniciatíva za právny štát) when preparing this report and its conclusions. Verkhovna Rada adopts the law 11484, necessary for the Rome Statute ratification to come into effect. What`s next? 1️⃣ The President of Ukraine should sign the law 11484 for it and the ratification law to come into force. Then Ukraine should submit the ratification instruments to the UN Depositary. 2️⃣ Ukraine will not be joining the Assembly of States Parties as a full ICC member this year. All the steps should have been made before the end of September for ratification to enter into force in December this year. 3️⃣ As law 11484 provides limited changes, we should now move to comprehensive work regarding the effective implementation of the Rome Statute provisions in domestic legislation, as well as other international standards related to conflict-related justice and international crimes. It is crucial to engage all the relevant stakeholders, justice system actors, and civil society in a meaningful conversation on the matter. One of the fora to do it can be the Dialogue Group on Ukraine Accountability. 4️⃣ Ukraine should refrain from applying article 124 – a compromise to move the ratification forward, but one that goes against the interests of victims in Ukraine and the spirit of the Rome Statute. We should unite the efforts to overcome existing prejudices without undermining the ICC and the international justice system as a whole.
