With 2 reboots including a current one on Netflix, Unsolved Mysteries has been both successful and a cultural phenomena . Why did the show work so well? Something from the most recent #TheBundle episode: 📝 Once poison-pill clauses related to mininum credit ratings or escrow deposits (which #Amazon both did in its agreed-upon contract with the #NBA) are deemed material to a media rights agreement, it might be fair to say that “last match rights” aren’t worth the paper they are written on. On the other hand, rights-owning organization are certainly free to seek and accept such terms if consistent with its legitimate business interests — however onerous they might be. Some purpose for LMR may remain, though, such as market price discovery. 🚨 In related news: S&P Global revises its outlook for Warner Bros. Discovery to negative, from stable, while affirming its ‘BBB’ credit rating — I guess managing the risk of credit/payment default is in the legitimate business interest of the NBA (or any other rights owner). 🏀 From sports business to sports arena: It’s like NBA teams front-load restricted free agency offers to exploit financial restrictions (salary cap) of the incumbent team — making it hard(er) to match exact terms. 🎧 On the Unofficial Partner podcast: “Last matching rights” and “exclusive negotiation periods” clauses are having what COVID was for “force majeure events” — expect less room for interpretation in future high-stake media rights agreements. 📺 Murray Barnett on another poison-pill dimension: the definition of television 👇🏼
