As Nigeria strengthens its position as a leading arbitration-friendly jurisdiction, anti-suit and anti-arbitration injunctions become increasingly significant in commercial disputes. These injunctions not only influence parties' choices in dispute resolution but also introduce complex procedural challenges. Alternative Dispute Resolution (ADR) has been the best legal route for settling disputes without rancour. The machinery of Negotiation, Arbitration and Conciliation makes it cost-effective and result-oriented. Unfortunately, we have not deemed it fit to explore this available means of settling disputes in Nigeria.

This afternoon, I have the privilege of moderating an engaging session titled "The Relationship Between the Courts and Arbitration in Nigeria: Support or Undue Interference?" for the CIArb PHC Chapter. In this session, we will explore the complex relationship between the courts and arbitration practices in Nigeria. We will examine whether the courts serve as supportive allies in the arbitration process or if they sometimes interfere inappropriately. One of the notable provisions of the Arbitration and Mediation Act, 2023 (AMA), is the introduction of Third-Party Funding (TPF) for arbitrations seated in Nigeria and arbitration-related proceedings in Nigerian courts. Under this new legal regime, the twin torts of maintenance and champerty have been abolished, ensuring that Third-Party Funders are protected when enforcing Third-Party Funding Agreements (TPFAs) or foreign awards arising from such agreements in Nigeria.
