🖊 This week's Warning Letter is slightly different from the ones we usually cover. An FDA inspection of a clinical investigation site identified a single, but very important, objectionable condition: failure to adequately control investigational drugs containing controlled substances. And it wasn't just that the controls were lax. Actual thefts had occurred - 110 times! 🤯 🛑 The inadequate controls included storing the drugs outside the secure room intended for control and not limiting access to the room. As we've discussed before, responding to such inspectional observations can be tricky. In this case, the response included actions that seemed to make sense: installing an electronic keypad on the storage room door, enabling automatic locking, installing motion-detecting video surveillance within the room, requiring weekly inventory reviews, and increasing the size of the room to ensure all received materials have space. 🛑 All of this sounds great, but they forgot one important element: an indication of how all of this would be managed. What's missing includes how it will be determined who can access the room, how those people will be trained, what types of surveillance events are to be watched for, and what to do if events or inventory discrepancies occur. Responses require lots of dotting of i's and crossing of t's to avoid more serious actions, like Warning Letters or worse. The Department of Safety and Professional Services (DSPS) has been contacted by multiple professionals, saying they got a call from a man who claimed to be a DSPS investigator and further claimed the license holder is a suspect in drug trafficking and other illegal activity. These scammers can be convincing, even providing a badge number and case number, but please remember DSPS and state regulatory boards will never contact credential holders requesting payment to clear or restore licenses.
