Here are three key takeaways: ⚪ Recognition of High Standards for Demonstrating Damages - ECJ consistently demands that plaintiffs must demonstrate specific and causal damage resulting from GDPR infringement. This high bar for demonstrating damages confirms that the mere assertion of fear without proven negative consequences is insufficient – such as fears of misuse of data. This reaffirmation supports businesses by filtering out unjustified claims. ⚪ Data Theft ≠ Identity Theft - ECJ concludes that the theft of personal data cannot be regarded as identity theft or identity fraud.
