Is your website accessible? Are you breaking the law because it isn’t? Since September 2018, the Government Digital Service (GDS) has been monitoring public sector websites and mobile apps to ensure they meet the success criteria set by the WCAG guidelines. In October 2023, the World Wide Web Consortium (W3C) released WCAG 2.2, the latest version of these guidelines. Starting in October 2024, the GDS will begin monitoring websites for compliance with these new criteria. ❗ 🔔 Do you develop, publish, distribute, or intermediate the distribution of standalone software for consumers to use in the EU - that includes apps and computer games? Then this alert is for you 📩 the European Commission says new GPSR applies to standalone software, including games and apps, as of 13 December 2024 🔔 ❗ 🔴 The Commission has just provided its strongest indication yet that it considers its new rules on product safety (#GPSR) will apply to standalone software even though this is not expressly stated in the relevant laws. This is important because to date it has not been considered that standalone software itself is in scope so it is unclear how prepared those in software will be. 💻 This has significant potential implications for companies that develop, market, intermediate supply of apps, games and other software products - this includes app stores. ⏰ Since the new legislation will be enforced from December 13, 2024, companies in this space (which includes anyone supplying apps to consumers or operating an app store) need to consider what might need to be done in order to comply with the new rules if the Commission’s current position is maintained. ❓ The Commission has now published a Q&A document which made written reference to software being in scope – this is the clearest indication we have had yet from the Commission. 🔮 The position may become even clearer over the next three weeks when the hotly anticipated GPSR guidance is published. 🙃 Keep in mind that this dovetails into the new Product Liability Directive where a product is presumed defective if it does not comply with EU product safety rules...
