Within international humanitarian law, the critical nature of Article 19 of the Fourth Geneva Convention applies. This provision unequivocally protects hospitals and civilian infrastructure from military action. However, it's imperative to note the nuanced circumstances under which this protection may cease. Hospitals lose their protected status only if used for "acts harmful to the enemy" beyond their humanitarian purpose. Even then, strict protocols must be followed: due warning is given, a reasonable time limit is set, and a warning is unheeded. The burden of proof lies heavily on the attacker to demonstrate loss of protected status. The mere presence of wounded combatants or their small arms does not constitute harmful acts. Importantly, any attack must still adhere to principles of proportionality and precaution. Indiscriminate targeting of civilian infrastructure remains a potential war crime. In essence, Article 19 provides a narrow exception, not carte blanche for attacks on hospitals or civilian targets. Next week in Geneva we meet for the 5th session of the IGWG on PMSCs to continue discussing the international regulatory framework relating to the activities of private military and security companies. It is an encouraging and positive development that the mandate of the IGWG was renewed for the additional 3 years in 2023, but the states need to engage in a more constructive dialogue. The NATO Security Force Assistance - Centre of Excellence (NATO SFA COE), in collaboration with the NATO ACO Office of Legal Affairs (Supreme Headquarters Allied Powers Europe (SHAPE) and the International Institute of Humanitarian Law (IIHL) has launched its latest editorial project titled "Enhancing Stabilization and Strategic Partnership in a Post-Conflict Environment. A Comprehensive Approach to Human Security". A formation of #ChinaCoastGuard (#CCG) vessels departed on Friday morning for #Russia to carry out joint drills and patrol tasks between the two countries' coast guards, the CCG said Friday. The #Chinese and #Russian coast guards will hold joint drills in maritime security threat crackdown and maritime rescue, following which vessel formations of the two sides will jointly patrol waters in the northern #PacificOcean, according to the #CCG. The CCG noted that the drills and patrol tasks are not aimed at any third party and are unrelated to the current international and regional situations. The purpose is to consolidate and deepen the friendly and practical cooperation between the maritime law enforcement forces of the two countries, improve joint patrol organizational and coordination mechanisms, and enhance their ability to jointly respond to various maritime security threats, it added. #ExtremaRatio

China’s maritime police send two ships to Russia for joint patrols "The Sino-Russian drills and joint patrols are not directed against any third sides and have nothing to do with the current international and regional situation," China’s Coast Guard said BEIJING, September 13/ Two ships of China’s maritime police headed to Russia’s territorial waters for joint patrols and drills in the north Pacific, China’s Coast Guard said. On WeChat, the agency specified that the vessels Meishan and Xiushan sailed to Russia on Friday. Together with the Russian side, they plan to work on reacting more effectively to maritime security threats and conducting joint search-and-rescue operations. "The Sino-Russian drills and joint patrols are not directed against any third sides and have nothing to do with the current international and regional situation," it said in a statement. According to China’s Coast Guard, such events "aim to bolster and expand friendly and pragmatic cooperation" between the two countries’ law enforcement agencies. The key task is "shaping and enhancing" relevant planning and coordinating mechanisms and "boosting the skills of jointly counteracting any threats to maritime security," the agency concluded. #business #finance #financialservices
