Among many things, speculation around employers’ NI brings IR35 into sharp focus. If employers’ NI rises, so does the cost of non-compliance under the off-payroll rules. This is because HMRC will issue firms a tax bill made up of missing employment taxes in the event a contractor has been wrongly engaged outside IR35. Along with highlighting the importance of compliance, it shines the spotlight on businesses that insist all genuinely self-employed contractors work on the payroll. So HMRC will issue a bill if a Contractor is wrongfully engaged #OutsideIR35.. what about the shameless blanket Banning of PSCs resulting in uniform #InsideIR35 "assessments? HMRC need to step up and punish folks like the massive MSPs, Telcos and their ilk for taking a incorrect stance thinking they are protected from penalties while the Contractor community is screwed vigorously #JonTheHashtagGuy

That’s a nice “gift” for those contractors who do work (I.e. are forced to work) inside-ir35 against their will. As clients seem to effectively pass on the ErNICs through the Assignment Rate so the contractor is effectively paying them, that’s a gift that just keeps on giving eh? Those that want to work can’t work and, if they do, get screwed from all angles. I guess they have a different definition of “working people”…just like their definition of “economically inactive” meaning we’re all swanning around on golf courses, and has nothing to do with rampant ageism and trying to avoid being exploited.

On my deathbed, I hope someone whispers to me, “AI has finally cracked the code for IR35-compliant contracts that even HMRC can’t argue with.” Then, and only then, can I rest in peace knowing that freelance contractors can finally run their businesses without constant IR35 interruptions. I’m in my 40s now, so there’s still time…right?

If I had to guess I'd say it's to dodge the potential for years of legal action and fees even if they are eventually judged compliant, sadly.

Great question Nicole. The planned changes have certainly opened up a debate as to the rise in the use of contractors, which in turn will lead to the IR35 debate and the relaxation argument. It's going to be interesting how this plays out
