The proposal for an EO empowering a panel of retired F/GOs to remove three- and four-star F/GOs represents a fundamental misunderstanding of both civ-mil norms and the process by which officers are trained, evaluated, promoted, and assigned. On average, it takes about 25 years for an officer to be confirmed as a one-star general--meaning that between commissioning to the grade of O-1 and promoting to the grade of O-7, that F/GO has been nominated and confirmed by presidents across administrations. Three- and four-star generals and admirals are further appointed to the specific billet into which they are promoted--meaning that every current three and four-star F/GO has been vetted by their service, military department, DoD, the president, and the Senate at every level in order to attain their current position. The Founding Father delegates of the Second Continental Congress declared that the Thirteen Colonies were no longer subject (and subordinate) to the monarch of Britain, King George III, and were now united, free, and independent states. The Congress voted to approve independence by passing the Lee Resolution on July 2 and adopted the Declaration of Independence two days later, on July 4. This week, the Supreme Court made a decision that changed the relationship between the military and civilian leadership.  In particular, it highlighted a dubious role that SEAL Team Six might play in the increasingly bitter partisan political wars our nation continues to experience. The Supreme Court ruled that the Commander in Chief faces no possible criminal liability for issuing an illegal order. The military assumes all the risk once that order is issued.  It is the proverbial rock and a hard place for everyone in the Executive branch’s chain of command, from the Secretary of Defense to the E-1.
