Estate Planning Reminder: Why Regular Title Reviews Matter Today, I'm reminded of the crucial importance of monitoring how your property title is held, particularly after life events such as refinancing, marriage, or a family loss. Let me share an enlightening experience. Yesterday, a client reached out amid the grief of losing both parents within a week. They were assessing two properties, believed to be securely held in their parents trust, a smart move for any estate plan. However, when we investigated the documents, we found that the properties were taken out of the trust and put back under their individual names as joint tenants when they refinanced a few years back. This might seem like a small detail, but has now led to a big headache. The family now faces the complex and costly task of filing a Heggstad petition—a legal process in California that enables property to be placed back into a trust posthumously, assuming it aligns with the deceased's intentions. This situation could have been easily avoided with a routine title review after the refinancing. It's a vital lesson for all: Regularly reviewing your property titles is not just procedural; it’s a fundamental part of protecting your family's future.
