Federal officials have introduced a new way to report if someone is denied emergency care. This means you can tell the U.S. government if a hospital doesn't give you the help you need in an emergency. According to a law called the Emergency Medical Treatment and Labor Act (EMTALA), everyone in America has the right to emergency medical care. This law says that hospitals getting federal money must help or move patients who need emergency care, no matter if they can pay or if they have a mental illness. In other words, hospitals cannot refuse to help you. If you think a hospital turned you away unfairly, you can make an EMTALA complaint. FROM CMS.gov: "KNOW YOUR RIGHTS EMERGENCY MEDICAL TREATMENT AND LABOR ACT (EMTALA) EMTALA GUARANTEES ACCESS TO EMERGENCY MEDICAL SERVICES FOR INDIVIDUALS WHO PRESENT TO A HOSPITAL EMERGENCY DEPARTMENT REGARDLESS OF AN INDIVIDUAL’S ABILITY TO PAY It also provides for appropriate transfers if the presenting facility is unable to provide the care or services necessary to stabilize a medical condition."
