I know of a few in-house lawyers talking to external lawyers and corporate affairs folks to learn more about Senate Inquiry powers to compel documents and witnesses. The short answer is that Senate Committees can compel the production of documents and attendance of witnesses, but that's just the start. It's good to have 3-4 other things to talk to the business about as soon as Inquiry participation looks likely. Expecting some coverage this week of the Environmental and Communications References Committee's public hearings on Greenwashing. The Inquiry was announced over a year ago, but today is the first public hearing and involves senior attendees (see attached). If you want to have a chat about Inquiry powers (whether you're already in this situation or just a proactive preparer), let me know.
