As one step towards ensuring that there is speedy justice involving Gender Based Violence (GBV) cases, Oxfam in Malawi and Centre for Alternatives for Victimised Women and Children are working with the magistrate courts and Police in Phalombe and Balaka districts, Malawi, in facilitating mobile courts that take justice close to the people. The initiative which is being funded by Oxfam Hong Kong enables remote communities to access court justice without facing the financial burdens they often do when traveling long distances to access district designated courtrooms. This video highlights one of the sessions held early this year in Phalombe district where His Worship Leonard Mtosa, First Grade Magistrate for Phalombe Magistrate court facilitated a mobile court session and heard five cases in which four were sexual harassment offences involving minors. #16DaysofActivism #NotoGBV #Justice4All https://lnkd.in/dZUEeKqm

In the forthcoming days, I will be seeking Presidential intervention to tackle Police Brutality and Civilian Hostility and reinforce community policing reforms. Unfortunately, the Nigerian government has not yet actualized substantial police reforms, leaving young people fearful of leaving their homes due to the risks of torture, extortion, harassment, and unjustified killings. Similarly, citizen-police hostility is on the increase, resulting from negative experiences between Nigerians and law enforcement agencies. It has fostered deep-seated distrust, leading to intensified animosity against the police. Last week Te Kura Kaiwhakawā | Institute of Judicial Studies (Te Kura) hosted a delegation of judges and court staff from Singapore on a study tour to learn about the New Zealand approach to the management of sexual cases, with a view to implementing similar practices in their jurisdiction. The study tour looked at the operation of our Serious Sexual Violence Court Pilot and the changes introduced by the Sexual Violence Legislation Act 2021. The meetings with Te Kura focused on judicial education and best practice in sexual cases in New Zealand. #courtsofnz #judicial #education

Punishments serve five purposes: detention, deterrence (setting social norms), retribution, restitution, and rehabilitation. Many educators hyper-focus on the last one and conclude that punishment serves no purpose. Balancing the needs of the individual and the community is THE human dilemma. #PLCatWork

Gender-based violence (GBV) is a silent factor that is driving many women into the criminal justice system. According to UN Women, 1 in 3 women aged 15 and older has experienced physical or sexual violence in their lifetime. The Nigerian justice system faces numerous challenges in addressing GBV effectively. Many survivors encounter obstacles when seeking justice, due to cultural biases, inadequate legal frameworks, and limited support from law enforcement. These factors often lead to leniency towards perpetrators and further victimisation of survivors. Additionally, many women lack the financial resources to escape abusive situations or defend themselves in court. This creates cycles of injustice, disproportionately affecting women who enter the criminal justice system at various levels. A proactive judiciary and correctional system is essential for enforcing GBV laws effectively. On this International Day for the Elimination of Violence Against Women, Hope Behind Bars Africa calls for justice reform that addresses the impact of GBV and protects survivors rather than punishing them.
