Today's introduction of groundbreaking legislation in the U.S. to require transparency in the use of copyrighted works to train #GenAI models is acknowledgement of the important role that provenance plays for #ResponsibleAI.
Copyright Clearance Center (CCC) is a proud supporter of Rep. Schiff's important legislation which would require transparency regarding use of copyrighted works used to train GenAI models. No time to rest for the Copyright-Community (waiting for the Second Draft of the CoP:)): The UK government has today (17 December) announced a 10-week consultation, concluding on 25 February next year, "to clarify copyright law as it seeks to support the growth of the creative and artificial intelligence (AI) sectors while maintaining customary protections to intellectual-property owners". According to the announcement, the purpose of the consultation is to provide clear guidelines on the use of copyright-protected material in AI training, balancing innovation with safeguarding the rights of content creators. No question: VAUNET will also be closely involved here.

A good summary of the legal and business implications of uncertainty around use of copyrighted works to train AI. "AI developers are now at a crossroads. On the one hand they face protracted litigation from copyright content owners and a significant increase in risk of copyright infringement and a rejection of the fair use defense following Warhol. . . . they also face the crossroads of corporate and institutional clients reluctant to adopt the use of generative AI in the workplace given current litigation." Stability AI is facing two lawsuits in the US that contest the legitimacy of stable diffusion[4]. The plaintiff in the Copilot lawsuit is seeking injunctions to shut down these programs in addition to $9 billion. The two main points of contention are that consuming copyrighted content via the internet or other sources infringes on the copyright of the original works, and the results—whether they be source code, text, photos, or music—also violate derivative works. The U.S. Copyright Office is seeking public opinion on this matter. Some respond, "Oh, it's fair use and no problem," while others respond, "Oh, massive piracy and we got to shut this stuff down."
