PL&B International Conference 2024 Cooperation between the supervisory authorities is not only crucial but also legally necessary. The CJEU stated that the practices which harm data protection law can be an indication of an abuse of a dominant position. The competition authority must consider data protection issues in its work and must cooperate with the data protection authority. PL&B International Conference 2024 #Privacy is a fundamental right and not an obstacle to public or private interests. It generates trust. We can achieve public and private rights by protecting privacy which reinforces our objectives elsewhere. There are potential overlaps and gaps regarding laws on competition, copyright, broadcasting to promote certain content. Other relevant issues are equality rights; protection of children online while not sacrificing others’ privacy; finance and banking; money laundering and terrorism financing. A banking code of practice on sharing data will be approved by my office. Really interesting piece by Maia Edilashvili Biermann on IAM about Italy's trade secret protection regime and how advanced it is in comparison to much of the rest of Europe. "Between 1 January 2017 and 31 October 2022, there were 151 trade secret proceedings in Italy, with an appeal rate of just 11%," she reports. "By comparison, France had 52 cases, with an appeal rate of 76%, and Germany had 39 cases of which 53% went to higher instance. Similarly, Italy’s infringement claim success rate of 41% looks striking against the backdrop of the European average of just 27%." Why is this? As opposed to most other EU member states, trade secrets cases are tried at specialist IP courts, while there is also a strong body of case law that stretches back a number of years. Italy has a relatively low rate of patenting, could a comparatively strong trade secret protection regime at least partly explain that? If so, is that a good or bad thing? Well worth a read this. Singapore Process Serves 📜In early December 2023, I posted some information about major changes to Process Serving laws and rules in Singapore. I have just been checking competitor websites that offer process serving in Singapore. And I have to say that it amazes me how few process servers that operate in Singapore have taken the trouble to update their websites. They are not keeping up with the times and could potentialy cost you your case. These comments are in respect of just four companies claiming to serve in Singapore!! 🚩📜 “Singapore is not a signer of The Hague Service Convention “ Wrong! It is. It made changes to its entry in the Hague Convention back in May 2023 and on 1st December 2023, became a fully fledged member of the Hague Convention. 🚩📢 “There is no formal process service method in Singapore” Wrong! There is – now. With effect from 1st December 2023. This company offers informal service in Singapore. The recent changes announced by Singapore shows that it has stated that the Article 10 options are “Not applicable”. 🚩📜 “Singapore is not a party to either of the two international service of process treaties, so formal service requires Letters Rogatory” Wrong!! It is a signed-up member of the Hague Convention. 🚩Another site claims: “In general, we conduct our services through informal services which are the responsibility of our own process server to deliver the documents…” If you are intending to have documents served in Singapore, please do check that the company you are dealing with is keeping up with the times. Actually it is not as simple as it sounds. When travelling to a foreign country, the customs of a foreign country should be observed and respected. However, when foreign dignitaries are your guests, then they should extend the respect by following and observing your own country's customs. You should obviously consider the practices of the visitor as well, but your own country's practices and dress code should dominate. As an example, the dinner menu should be dominated by your own local cuisine, but obviously observe dietary restrictions of your guest whether religious or allergenic. In certain situations it differs, so for example when presenting Letters of Credence to the head of state you can wear your national dress and thus your own country's can custom overpowers local customs. In summary, when receiving guests you should extend the warmth and respect by incorporating their customs, but it is your own that you should take pride in and that you represent too. And remember, each gesture and etiquette will be taken as a sign, and it all depends on the situation.
