It's official! EU extends the deadline for EUDR compliance. The European Parliament has already voted in favor of postponing the implementation of Regulation (EU) 2023/1115. The new compliance deadline is December 30, 2025 for large and medium-sized companies, and June 30, 2026 for small and micro enterprises, providing an additional 12 months for preparation. Key points approved: · Countryrisk classification and reporting system to be available by June 30, 2025. · A general review of the Regulation is foreseen in June 2028, during which additional measures to simplify and reduce the administrative burden for the companies that have to apply it will be analyzed. It should not be forgotten that the agreed text must also be approved by the Council and published in the EU Official Journal before the end of 2024. From 30 December 2024, the EU Deforestation-free Regulation must be applied by all member states. Chapter 3 of the Regulation defines the obligations of member states and competent authorities, including checks on relevant actors, corrective action and penalties. Each member state is obliged to lay down rules, following the principles of effective, proportionate and dissuasive penalties. Penalties may include one or more of the following: ⚠️Maximum fines of 4% of the total annual turnover in the last financial year (the decision should take into account the environmental damage caused and the value of the goods concerned). ⚠️Confiscation of the goods and the revenue generated by their trade. ⚠️Exclusion from public procurement processes and public funding for a maximum period of 12 months. ⚠️Exclusion from the European markets for the relevant commodities and products concerned in the event of serious violations. ⚠️Prohibition of applying simplified due diligence in the event of serious or repeated violations. 🌳 𝗗𝗲𝗳𝗼𝗿𝗲𝘀𝘁𝗮𝘁𝗶𝗼𝗻 𝗥𝗲𝗴𝘂𝗹𝗮𝘁𝗶𝗼𝗻: 𝗘𝘅𝘁𝗿𝗮 𝗬𝗲𝗮𝗿 𝗳𝗼𝗿 𝗖𝗼𝗺𝗽𝗮𝗻𝗶𝗲𝘀 𝘁𝗼 𝗖𝗼𝗺𝗽𝗹𝘆 🌍 The European Parliament approved today a one-year extension for implementing the EUDR. Once formally endorsed by the EU Council, the new implementation date will be 30 December 2025 instead of 2024. 📜 𝗞𝗲𝘆 𝗛𝗶𝗴𝗵𝗹𝗶𝗴𝗵𝘁𝘀: 🔹 𝗣𝗮𝗿𝗹𝗶𝗮𝗺𝗲𝗻𝘁 𝗗𝗿𝗼𝗽𝘀 "𝗡𝗼 𝗥𝗶𝘀𝗸" 𝗖𝗮𝘁𝗲𝗴𝗼𝗿𝘆 The proposed amendment that would exempt operators from exercising due diligence for products from “no risk” countries faced strong opposition by Member States and was ultimately withdrawn. 🔹 𝗥𝗲𝗱𝘂𝗰𝗲𝗱 𝗔𝗱𝗺𝗶𝗻𝗶𝘀𝘁𝗿𝗮𝘁𝗶𝘃𝗲 𝗕𝘂𝗿𝗱𝗲𝗻 As part of the compromise, the European Commission has committed to easing the administrative burden on businesses by: ▪ Updating the Guidelines and FAQ section, ▪ Responding to feedback from stakeholders and Member States, ▪ Supporting traders and operators throughout the implementation process, ▪ Considering further measures for simplifying and reducing administrative requirements in the context of the general review of the Regulation, expected by 30 June 2028. 📌 𝗡𝗲𝘅𝘁 𝗦𝘁𝗲𝗽𝘀? 🔹 𝗖𝗼𝘂𝗻𝘁𝗿𝘆 𝗕𝗲𝗻𝗰𝗵𝗺𝗮𝗿𝗸𝗶𝗻𝗴 𝗦𝘆𝘀𝘁𝗲𝗺 The European Commission must finalize the country risk classification by 30 June 2025, ensuring predictability and providing stakeholders sufficient time to adapt their due diligence systems before implementation begins. 🔹 𝗙𝗼𝗿 𝗘𝘅𝗽𝗼𝗿𝘁𝗲𝗿𝘀, 𝗢𝗽𝗲𝗿𝗮𝘁𝗼𝗿𝘀 𝗮𝗻𝗱 𝗧𝗿𝗮𝗱𝗲𝗿𝘀 Time to close the gaps - clarify outstanding questions, finalize the structure of the due diligence system, adapt contractual arrangements, engage in the risk benchmarking procedure, and conduct thorough tests to ensure readiness. Thank you for the share. The 12 month delay for the EUDR is one thing, but there are are more fundamental questions regarding the scope of application which need addressing too. How far up (or down) value chains do the measures reach? How the many incidental parties will be brought into scope is a question that several in the industry are raising, particularly in countries such as Germany and France who already have forms of supply chain acts on their books (eg. the LkSG in Germany). Additionally, if there’s an extraterritorial read to EUDR, how will the regulation be enforced ex-EU, and will standards be comparable with those infra-EU? The 12 month delay should be used wisely by the authorities to triangulate on what is material impact, (not least given that some of the parties will be non-EU). EUDR DELAY The EU Commisdion has suggested a 12 month delay for EUDR. Clearly the EU Commission listened to concerns around its practical implementation and consequences. This proposed delay to the introduction of EUDR has not yet been approved though it is likely to go ahead. Please note though: 1. While any extension will offer a breathing space there is for many organisations still a lot to be done to be properly prepared. We suggest that this time is used carefully and thoughtfully to design an effective, cost efficient and risk managed system which is ready to utilise when needed together with a strong stakeholder engagement strategy which allows you to control the narrative and protect value (see below). Indeed most participants in affected industries have indicated to us that they will continue their implementation and not slow down their EUDR compliance. However, they have said that they are taking the extra time to consider a long term solution for future associated #sustainability requirements instead of a short term solution. 2. We are experiencing that, notwithstanding any delay in the implementation of the regulation, the cat is out of the bag. Many stakeholders are becoming increasingly concerned about the reputational and greenwashing risks associated with an inability to substantiate non deforested supply chain. Having the right strategy backed up by effective systems and processes has not necessarily been put on hold. It is more that organisations may now be given the time to put in place a supply chain strategy which is more effective and compliant and which can importantly protect value.
