Free Charity Governance Analysis I am currently studying for a Level 4 Certificate in Charity Law and Governance through the Chartered Institute of Governance. I have been asked to analyse the governance arrangements for a charity of choice, and to write a report which sets out the governance challenges faced by the organisation as well as proposals for how these challenges might be addressed. For my analysis, I will largely access public facing data about your organisation, however it would be helpful to also interview one or two of your senior team and/or board members to get more of an intimate feel for how the organisation operates and the finer details of your governance arrangements. I may also require access to certain documents and/or policies. As an estimate, I believe I will not need more than 2-4 hours of your time. When writing my assignment, I will be careful not to include any commercially sensitive or other information which should not be placed in the public domain. I will gladly share the final governance review with your team, which will include sound proposals on how any governance challenges faced by your organisation could be addressed, based on my comprehensive learning. If you are a a legitimate UK based organisation with an established governance structure, and are interested in a free governance review please reach out to me by the end of May 2024.

“As a general rule, a trustee sufficiently discharges his duty if he takes in managing trust affairs all those precautions which an ordinary prudent man of business would take in managing similar affairs of his own” Speight v Gaunt (1883) 9 App Case 1, 19 per Lord Blackburn. 2 The standard that has been applied to charity trustees in acting with reasonable care and skill was established many years ago. Obviously, we can modernise the standard by applying gender neutral wording - that all trustees should act with reasonable care and skill and take the precautions that an ordinary prudent person of business would take in managing their own affairs. Anyone who would have specialist knowledge such as a legal advisor, accountant or auditor may be held to a higher standard in respect of any decisions or knowledge that they should have applied in their role as trustee. Acting with reasonable care and skill does not necessarily mean that trustees need to know the answers to all the issues that arise in their role as trustee. It means knowing when to seek specialist expertise to allow the board to be sufficiently informed when it comes to decision making. #CharityLaw #Governance #BestPractice #TrusteesWeek

Under this law, it will be possible to litigate disputes between consumers and businesses over rights or legitimate interests arising after 24 November 2020. The law is based on the principle of a representative action brought by a non-profit organization with an opt-in framework for consumers. All innovation starts somewhere. We took the original Keystone Law fee split model (2002, kudos to them) and radically altered it. We did this by paying our lawyers 28% more than the fee sharing models (for transparency we pay 90% - 95% fee split) and we choose the most excellent trusted lawyers and teams. We even give lawyers 10% of their clients’ fees annually after they retire. As the lawyers all get paid more they can afford to charge clients less. The more excellent lawyers and clients create a large profit all of which we give to charity. We are in the business of making the business of law better for lawyers, clients and society. The next innovators will, one day, hopefully build on from this, making it even better for more people. I do wonder though if they can apply our model to more than just the business of law? #law #lawyers #innovation #nextgen
