If you need to make an application to the Federal Circuit Court and Family Court of Australia, you might be required to supply an affidavit in evidence of the circumstances and facts of your case. This is because there is limited opportunity for you to give a personal account of your evidence in court and submitting evidence by affidavit allows your family law case to run more quickly and efficiently. Here’s a quick summary of the key points when preparing your Affidavit: ✔️ You can use a Justice of the Peace, Commissioner for taking Affidavits, solicitor, or barrister to witness your affidavit. ✔️ You should sign the bottom of each page in the presence of your witness, who will sign each page with you. ✔️ You should then sign the last page in the presence of your witness, who will then sign and seal the document with their credentials. ✔️ Be sure to take some ID with you to prove who you are to the witness. ✔️ There may be options to electronically sign or use remote witnessing. The Critical Importance of an Affidavit in Legal Proceedings 📜⚖️ Today's court experience underscored the significance of preparing AFFIDAVITS. During the proceedings, a minor error was discovered in the opposing party’s affidavit. What was claimed to be a mere “TYPING ERROR” this completely turned the course of the case. When we pointed it out during our arguments, the opposition objected, but the judge's response was both clear and powerful, As "An affidavit is a sworn statement, attested by the party, who confirms they have thoroughly read and understood its contents before signing. It is not just another document it is a formal declaration of truth. As such, errors, however small, are not easily excusable once the affidavit is presented in court." This situation serves as a crucial reminder for all legal professionals that is "DOUBLE CHECK" every details before submitting an affidavit. This is one of my favourite benefits of mediation. Mediation empowers separated parents to make their own decisions rather than having a judge impose decisions on them. The judges are amazing professionals but you are the expert on your life and you know your children better than anyone. You and your ex partner are the best people to make agreements for your family. Plus, Research from the Journal of Family Law suggests that parents who reach agreements through mediation are more likely to adhere to those agreements because they were directly involved in making the agreements. This sense of ownership over the outcomes increases the likelihood of long-term compliance and satisfaction. DOES YOUR MEDIATOR USE CASELINES? The most significant change in the digitization of the Ontario Superior Court has been the introduction and use of CaseLines for civil matters. When a court file begins, parties are invited to CaseLines and can upload their pleadings, motions material and documentary evidence. The complete court file is then instantly available to the court. Individuals such as experts and mediators can be invited by a party to share specific parts of the CaseLines file. Have you though about inviting your mediator to join your CaseLines file? Although not all mediators are experienced in using it, for those that can, it will save the parties time in preparing for their mediation sessions. Why put together a new mediation brief when all of the necessary documents (pleadings and key documents) for the mediation are already in CaseLines?
