The European Union raises the bar on supply chain due diligence obligations. The EU Parliament has just adopted the Corporate Sustainability Due Diligence Directive (CSDDD) with 17 EU Member States voting for it and 10 abstaining. A debate that lasted over two years with various compromises between the Council and the member states. The European States have two years to enforce this directive into their legislation. The directive introduces corporate obligations regarding the adverse impacts of business activities on human rights and environmental protection. It also lays down the liabilities linked to these obligations. The rules concern not only the companies’ operations, but also the activities of their subsidiaries, and those of their business partners along the companies’ supply chains. Companies affected by the directive must also adopt and implement a climate transition plan in line with the Paris Agreement on climate change. The directive first affects companies with over 1,000 employees and a more than €450 million turnover. Companies with more than 5,000 employees and a turnover of €1.5 billion and up have until 2027 to comply, while enforcement will come later for the others (2028 for 3,000 employees, 2029 for 1,000 employees). The main due diligence obligations require companies to a) implement due diligence policies, b) identify and assess potential negative impacts and act (prevention and remediation), c) obtain contractual assurances from business partners, d) provide support to SMEs and e) publish on their website an annual report. Although compromises have made it possible to limit the number of companies directly targeted by the directive, the impact will be felt by hundreds of thousands of supply chain actors. Take for example Unilever and its some 54,000 direct suppliers. How many suppliers will Unilever need to engage with and investigate? This CSDDD reinforces the trend in recent years to insert due diligence obligations into supply chain legislation. There is growing pressure on states outside Europe to follow suit. From a manufacturer and supplier perspective, it adds complexity to supply chain management, requiring businesses to adapt and comply with these evolving standards. Two actions to implement rapidly: map supply chains and engage with upstream suppliers. #supplychain #compliance #supplychainregulation

Robert's Insight: As the world's trade is more complex, it requires manufacturers/suppliers to run quickly and smartly to catch up with the new changes in regulatory requirements, especially the EU member states. Whether we are talking about: 1. HRDD (Human rights due diligence). 2. EUCSDDD (EU's corporate sustainability due diligence directive). 3. DPP (Digital product passport). 4. ESPR (Eco-designed for sustainable products regulation). 5. EUDR (EU's deforestation regulation). All of these have a significant impact on people and the environment.
