With the world’s focus on the USA Presidential Election, we thought it was interesting to take a look at whether issues affecting the worker feature in the respective Democrat/Republican bid for votes. After all, the changing employment landscape, is top of the agenda here in the UK and the subject of our forthcoming seminar on the 12th November. Surprisingly, in the USA, a country where Worker Protections are widely viewed as lagging well behind Europe, the subject does feature a little in the current Presidential debate. Issues such as the minimum wage, a staggeringly low $7.25 per hour, job creation, overtime pay and Union recognition have all received airtime, with the respective parties having clear blue water between them. However, possibly the most interesting employment issue that has featured is that of “employee non-competes”. It is estimated that in the USA an unbelievable 30m employees have signed such agreements with their employers, almost the same number as the entire UK workforce. Once again, the Democrats and Republicans have very different views on the subject, with proposed legislation to limit such arrangements the subject of much disagreement in the legislature and, inevitably, the US legal system. Here In the UK, non-compete clauses/business protection agreements remain part of our employment landscape, despite regular reviews, however, the recently introduced Employment Rights Bill did not include anything new. The new rule uses the six-factor test, which evaluates the "economic reality" between a potential employer and a worker. As misclassification of workers is a quick and easy way to incur steep penalties, employers who utilize independent contractors should review the requirements of the DOL's new rule.
