Did you know that #Texas notaries are required by Texas law to securely keep copies of their notarization records for a specific period of time? 📝 Texas online notaries are required to retain records of an online notarization, in a safe and secure manner, for five years following the date of the notarization. Texas law also requires online notaries to maintain a back-up of the electronic records for the same period of time. Both the original records and the back-up are required to be protected from unauthorized use. [1 TAC §87.54(b)] Texas traditional notaries (in-person notaries) are required to retain records of a notarization, in a safe and secure manner, for the term of the notary's commission in which the notarization occurred or three years following the date of notarization. Don't ignore an offer to mediate. That is the clear message from this case, Northamber PLC v Genee World Ltd & Ors. Although considerable costs had already been incurred on both sides, Northamber's solicitors offered mediation writing "“Whilst the Claimant remains committed to pursuing the action it also remains open to mediation as a method of resolving the dispute. We would ask you to take instructions from your clients and for an indication, by return, as to their willingness to mediate." In not responding, not accepting mediation and not providing a witness statement setting out the reasons for refusal, the Appeal Court ruled that the defendants "were silent in the face of an offer to mediate. That was in itself unreasonable." The key takeaway is that silence in response to an offer to mediate is likely to be "unreasonable". If there are valid reasons not to accept mediation, then these should be communicated. As so often, a clear communication/evidence trail is important in a contract dispute.
