As business owners who have filed their 2023 tax returns this spring are aware, the temporary rules governing deductions for business-related meals and entertainment (M/E) during the Covid-19 pandemic expired at the end of 2022. 36 states now have an optional pass-through entity (PTE) level tax. Our states gave us this tax planning gift because of the $10k state and local tax deduction limitation implemented by the Tax Cuts and Jobs Act (TCJA) of 2017. The PTE-level tax is an election that allows partnerships and S-corporations to pay a corporate tax at the state level and deduct it for Federal purposes. The tax paid can also be claimed as a credit on the partner/shareholder's returns. The problem is that some states (e.g., NY/NYC) require you to make the election by March 15 of the year it is to take effect. Forgetting to make this election can have devastating consequences in super-profitable years.
