Immigration update 482 visas Decision Time Frames - Immigration is increasing staff to improve service. They say complete cases that meet all the criteria could be decided within 1-4 weeks, and that cases with complexity may taking longer. Work Limiting Condition Changed - Workers are currently allowed to leave their sponsor and work for other employers in any job for up to 6 months. That was announced here: https://lnkd.in/gdi_ZJud I hear Immigration implemented this allowance to prevent exploitation of workers, and was surprised when workers exploited the new rules. Sponsorship obligations continue to apply after a worker leaves (often until another sponsor takes over) so employers should notify Immigration ASAP when a worker ceases work. Student visas IMMI is cracking down on student visa applications that don’t meet their new expectations. Currently more than 1 in every 5 is being rejected. Parent visas The government is aware of the various technical issues impacting parents (in particular secondary applicants for aged-parent onshore & holders of temporary parent visas) and is working to resolve them. While Immigration have indicated they will deal with individual situations ‘flexibly’ there’s currently no indication of when the issues will be resolved.

The U.S. Department of State has officially announced that all available EB-2 visas for FY 2024 have been issued. As a result, U.S. embassies and consulates will not issue any additional EB-2 visas until the new fiscal year begins on October 1, 2024. This temporary halt affects both employers looking to hire foreign professionals with advanced degrees or exceptional abilities, and workers seeking EB-2 visas. However, this is an opportunity to prepare for the upcoming FY 2025 visa window. Read more: https://lnkd.in/gyYkJq3M #eb2 #workvisa #immigration #immigrationlawyer #immigrationattorney

What's the new in immigration? November Updates on Visa Policies United States: The latest Visa Bulletin shows little movement in priority dates for both family-based and employment-based green cards, with significant backlogs, particularly for applicants from India, Mexico, and the Philippines. Employment-based categories (like EB-1 for extraordinary individuals and EB-2 for advanced degree holders) remain steady, with the cut-off date for high-demand countries often backlogged to 2013–2016 for certain categories. Family-sponsored visas have also seen limited movement, particularly for siblings and married children of U.S. citizens (F-4 and F-3 categories), reflecting high demand and country-specific caps. United Kingdom: The U.K. continues to face immigration pressures, particularly due to high demand for work visas in tech and healthcare. The government has been discussing potential changes in work visa rules to balance skill needs with immigration control, including reconsidering the salary thresholds for work visas. For students, post-study work visas remain attractive, but the government may make adjustments to align with its goals to manage net migration. Italy: Italy plans to start requiring biometric data for national visa applicants in January 2025, aligning with the Schengen area’s rules. Additionally, Italy is digitizing its work permit process, meaning employers and workers will no longer need to sign contracts in person at immigration offices. Employers now have digital responsibilities to submit documents and confirm permits promptly Starting your migration journey can feel overwhelming. We're here to make it easier for you! Why Have UK Immigration Numbers Dropped? Discover What’s Changing In a sweeping change, UK immigration saw a 27% drop in visa grants during the first half of 2024, as revealed by recent UK in Changing Europe data. New restrictions have limited visa eligibility for Master’s students and care workers, and higher salary thresholds for skilled workers are now in place. Most strikingly, health and care visas plummeted by 80%, with skilled worker applications also decreasing by 25% since April. London remains the epicenter for skilled worker visas, with 56% of total sponsorships, while the health and care sector shows broader regional distribution, indicating fresh prospects across various UK sectors. Despite the tighter criteria, these shifts present an opportunity for well-prepared applicants to stand out. In an environment of heightened scrutiny, expert guidance is key.
