DOES DIGGING A TRENCH AMOUNT TO A MATERIAL START? NOT IN NORTHERN IRELAND. An interesting decision of the Planning Appeals Commission today, indicating that in contrast to England and Wales where it is established that a digging of a foundation can amount to a material commencement of a permission (section 56(4)(b) Town and Country Planning Act 1990), the digging of a trench does not amount to a material commencement of a permission in Northern Ireland where the development consists of or includes the erection of a building because it is not itself "work of construction in the course of the erection of the building" (section 63(2)(a) Planning Act (Northern Ireland) 2011. The work of construction starts with the pouring of concrete into the trench (see ¶12). Takeaway: to be safe when commencing such development, dig the trench *AND* pour the concrete within the time limit and get evidence of the same.
