Even the fact that there is a Treaty Authority reflects the enormous political, legal and cultural imagination to co-exist Lore, Law and Cultural Authority in a legal context that is the product of, and still producing, colonisation (that will necessarily be challenged through this process). From afar, it looks like leaders understanding on their own terms where they are and where they need to get to. These kinds innovations don't come by chance. They come from a deep well of wisdom and imagination and community connection, and the ability to make change within political constraints and windows. The Treaty Authority has now written to the Minister for Treaty and First Peoples to invite the State of Victoria to commence negotiations for Statewide Treaty with the First Peoples’ Assembly of Victoria. For Treaty negotiations to start, the State must accept the invitation and demonstrate its readiness to commence Treaty negotiations. For over 20 years, Indigenous Modern Treaty Partners have called for independent oversight to hold the federal government accountable to Parliament for its Modern Treaty committments. This year, the Commissioner for Modern Treaty Implementation was announced to do just that. https://lnkd.in/gg7ht5Nw Modern Treaties are a distinct expression of reconciliation – a constitutionally entrenched commitment between the Crown and Indigenous partners to build true nation-to-nation, Inuit-Crown, and government-to-government relationships. A principled approach to government Treaty commitments Treaty Principles are an important means by which the agreement of Te Tiriti is upheld by government. Despite this, our current government has unilaterally decided to review, replace, and repeal or rewrite Treaty Principles. It is critical that the government actions reflect these central understandings established in law: - A treaty is an agreement between independent nations - Any interpretation of meaning, or change of terms, must be agreed to by the parties to that agreement - Any interpretation must reflect the agreement itself We can advocate for this principled approach together and protect the progress that has been made towards honouring Te Tiriti. Another day, another seminar! 📚 Seminar series by the University of Cambridge, with the presence of Advocate General, CJEU (2006 - 2020) Eleanor Sharpston KC and professor Dr Markus Gehring about the importance of Treaty reforms in the EU in order for enlargement of the Union! 🇪🇺 ‘The 2023 Franco-German Proposal on Reforming and Enlarging the EU – A Conversation’ was the topic of the discussion. One thought I feel the need to share from this seminar about the political will for the enlargement and Treaty reforms: "The EU must open its windows and let the air in. And I find it refreshing". Sept 15 | Treaty 4 “Today there are misconceptions that only First Nations peoples are part of the Treaties, but that’s not the case. As the phrase “we are all Treaty people,” implies, both Indigenous and non-Indigenous people in Saskatchewan are part of the Treaty.
