Legitimacy of a state / its government per se is not a concern for public international law (PIL). Similarly, "preventive defence" is not accepted as a legal basis for use of armed force. PIL is important in formulating and implementing national security and national defence policies. In this regard, it should be noted that, adversaries will also benefit (?) from "coercion-tools" accepted in PIL, as they may deem it necessary: equality of arms, reciprocity, counter-measures, reprisals, etc.

Text of UN Human Rights Council Resolution regarding arms passed today 5.4.2024 12. “Recognizes that the grave violations of multiple peremptory norms by Israel constitute a threat to international peace and security and result in grave breaches and human rights abuses, and calls upon all States to ensure that their arms exports do not contribute to or benefit from this unlawful situation; 13. Calls upon all States to cease the sale, transfer and diversion of arms, munitions and other military equipment to Israel, the occupying Power, in order to prevent further violations of international humanitarian law and violations and abuses of human rights, and to refrain, in accordance with international norms and standards, from the export, sale or transfer of surveillance goods and technologies and less-lethal weapons, including “dual-use” items, when they assess that there are reasonable grounds to suspect that such goods, technologies or weapons might be used to violate or abuse human rights, and recalls the order of the International Court of Justice of 26 January 2024, determining that there is a plausible risk of genocide in Gaza; Building blocks although no immediate impact. We do have however Limited Liability Companies (LLC) who provide military related services❌ Even during full-scale war with russia, the draft law № 11214 does not provide for operations on Ukrainian soil🚫 There is no political will behind this draft law, that’s the reason why the draft law didn’t pass into law. When it was necessary, we created Territorial Defence Force, Voluntary Formation of Territorial Community, we even created the International Legion for the Defence of Ukraine but PMCs we’ve been trying to legitimize for six years but we’re still stuck in the first gear👎

We’ve arrived at a stage where assessments are highlighting the fact that Israel (i.e. the Israeli government) isn’t actively obstructing humanitarian assistance at the largest possible scale as something positive. This should be the bare minimum. Anything else contradicts international humanitarian law. Meanwhile, recent reports describe Israeli efforts to mitigate civilian harm as "inconsistent, ineffective and inadequate". No doubt that Hamas’ use of civilians is making things even more complicated (and despicable). However, "Israel has the knowledge, experience, and tools to implement best practices for mitigating civilian harm in its military operations…results on the ground, including high levels of civilian casualties, raise substantial questions as to whether the IDF is using them effectively in all cases". https://lnkd.in/dUw2QG7T
