Truth vs. Justice: Embracing the Grey Areas in Transitional Justice I am currently working on a group presentation for the YORJA volunteer training on the Truth and Dignity Commission (IVD) in Tunisia. In the course of this preparation, something intriguing has stood out for me—the Truth vs. Justice debate. The conventional perspective often forces us to see issues in black and white: right or wrong, truth or justice. However, this dichotomy is especially complex in the context of transitional justice, where the goal extends beyond mere punishment to fostering societal healing and reconciliation. Amnesties, for instance, can be seen as a means of reconciliation but can also be perceived as "selling out of justice to transient political interests, to the detriment of democratic prospects." The Intriguing Truth vs. Justice Debate In transitional contexts, the debate on whether criminal proceedings are the only way to achieve justice or whether alternative paths such as amnesties can also lead to peace is profound. This debate, often referred to as peace vs. justice or truth vs. justice, highlights the challenges and complexities in balancing these objectives. Is there a grey area in our approach to transitional justice? Teitel (2000) suggests that in transitional periods, punishment should be corrective, extending beyond individual perpetrators to the broader society. This perspective invites us to move beyond binary thinking and recognize the shades of grey in addressing past wrongs. Embracing grey areas means acknowledging that achieving both truth and justice may require compromises and a broader societal focus. The Truth vs. Justice debate in transitional justice contexts challenges us to rethink our conventional views. The Smart Move Community, in collaboration with the @NationalCrimeResearchCentre (NCRC), conducted a study to better understand the relationship between religion and crime in Kenya. This initiative represents a systems-thinking approach, addressing how interconnected societal, cultural, and institutional factors influence crime patterns. By examining these dynamics, the study aims to provide insights that inform systemic change in crime prevention and policy formulation. The project was made possible through financial support from the Government of Kenya and was guided by the strategic leadership of Hon. Justin B. N. Muturi and the technical expertise of the NCRC’s Research and Development Committee, chaired by Mr. Samuel Wakanyua.
