On 26 July 2021 a 44-year-old worker sustained serious injuries when he was struck by a compact skid steer track loader (bobcat) at a worksite in Bundanoon NSW. Troy Justen Adams was the sole director and secretary of TBN Civil Pty Ltd which was engaged to conduct the construction work at the site including widening a section of road. To widen the roadway, a bobcat was used to grade the road base. At various times during the day, a worker would need to enter the newly widened roadway to measure its elevation using a handheld device. Mr Adams failed to exercise due diligence to ensure TBN Civil Pty Ltd had a safe system of work for the task of widening the roadway which adequately addressed the risk of workers being hit, struck, or crushed by the bobcat. Mr Adams entered a plea of guilty to an offence under sections 32/27 of the Work Health and Safety Act 2011 and was fined $30,400. Mr Adams has the right to appeal this sentence. #SafeWorkNSW #Prosecution

So much for the new laws. He got off light to repeat his actions.
