🙋🏽♀️ What standard of workplace training may be needed to prevent unlawful workplace behaviour, such as bullying and sexual harassment? 🙋🏽 According to the decision of Samad v Phosphate Resources Ltd T/A Christmas Island Phosphates [2024] FWC 2868: ❌ a 30-minute “tool-box talk” with employees was not a process or timeframe conducive to explaining and promoting serious workplace behavioural requirements to employees, particularly where there may have been some employee language barriers. ❌ workplace training on acceptable workplace behaviour should not be a “tick and flick” exercise ✅ Rather, prevention training should be through a culturally and linguistically appropriate interactive training course that deals with not just the “what” but also the “why.” Further, had the Employer fully communicated and implemented its suite of prevention policies at the particular work site on which the dismissed employee was engaged, and had the dismissed employee had more exposure to and understanding of the behaviours expected by the relevant policies and consequences for breach, the likelihood of him engaging in the behaviours for which he was dismissed, would have likely been reduced. This discretionary factor was relevant to the FWC finding that the applicant’s termination of employment was unfair under the Fair Work Act’s unfair dismissal provisions.

Beyond Paper: Effective POSH Implementation In today’s workplace, having a Prevention of Sexual Harassment (POSH) policy is a legal necessity, but it’s not enough to simply have a document filed away. Many organizations have policies written down, yet fail to take the crucial next steps: conducting employee workshops and establishing an Internal Complaints Committee (ICC). This disconnect can undermine the very purpose of the policy and leave employees feeling unsupported. Compliance shouldn’t just be a checkbox. Without active engagement, policies remain empty. Employees need to know how to report incidents and understand their rights; otherwise, the policy's purpose is defeated. Active engagement in training and support shows a genuine commitment to employee safety Action Steps: 🔺 Schedule Workshops: Plan regular POSH workshops with external trainers.
