Earlier this week, SAPI members had a unique opportunity to explore the role of Alternative Dispute Resolution (ADR) in addressing complex issues in life sciences, thanks to an exclusive event co-hosted with the World Intellectual Property Organization – WIPO and its WIPO Arbitration and Mediation Center. Our members heard directly from WIPO’s experts on how ADR can be effectively applied in the life sciences sector to address challenges such as licensing agreements, patent disputes, R&D collaborations, and more. A special thanks to our speakers: • Christina Teo, Executive Director of SAPI, who opened the session with a thoughtful introduction on the importance of ADR in supporting innovation. • Caleb Goh, Legal Officer at WIPO AMC Singapore, who shared valuable insights on WIPO’s strategies for handling disputes in IP and technology. • Isha Singh, Legal Case Manager at WIPO AMC Geneva, who wrapped up the event with real-life case studies, highlighting how WIPO ADR has helped life sciences organizations navigate high-stakes conflicts. 🌍Strengthening Global IP Collaboration: YUIL HIGHEST & Beijing Tee & Howe Law Firm Lunch Meeting 🌍 Today, our team at YUIL HIGHEST International Patent & Law Firm, including Eungu KIM, Esq., Jack Eui-Hwan Jung, Esq., and Hannah Hayoung Lee, Esq., had a wonderful lunch with Toby Mak, Senior Counselor and Patent Attorney at Beijing Tee & Howe Law Firm. During our meal, we reflected on our recent conversations at the KINPA (Korea Intellectual Property Association) conference and exchanged views on IP issues and business opportunities across global markets, including China, Korea, the U.S., and Europe. Toby also shared valuable insights into industry trends from his experiences with several organizations, such as IPO (Intellectual Property Owners Association) and AIPPI (The International Association for the Protection of Intellectual Property). We have just published our first ever strategy relating to Standard Essential Patents (SEPs), a complex and often misunderstood area of intellectual property (IP). This strategy rests on four pillars: 1- WIPO as a forum for discussion 2- WIPO as a source of knowledge and data 3- WIPO as a venue for amicable agreement 4- WIPO as a provider of services The activities foreseen under the strategy will enhance transparency, contribute to the discussion around SEPs, and aim at improving the quality of patents as well. WIPO seeks to facilitate transactions relating to SEPs in a way that does not preempt but instead complements the policies of different jurisdictions. This is an important step in addressing the management and licensing of SEPs, which raises significant questions at the intersection of patent law and competition law. We are looking forward to implementing this strategy and engaging in discussions and facilitating transactions relating to SEPs. So, perhaps two thirds of the Australian IP patent firm market is controlled by two IP holding firms: (i) IPH; and (ii) Qantm. IPH is the mother ship for Spruson & Ferguson and Griffiths Hack. Qantm is the mother ship for DCC and FPA. The remaining third of the Australian market is in the hands of "independents" notably POF and FB Rice. MIP recently posted an article with the implication that Corporates were veering away from Australian patent firms where the mother ship was listed on the ASX. I find that hard to believe. But, it does seem to me that Australian patent attorneys are not as tightly regulated as UK/EP patent attorneys. But equally, if your parent company is listed on the ASX then this brings with it a whole new dimension re: disclosure and transparency which "independent" patent firms do not need to provide. I have great respect for both IPH and the independents (POF/FB Rice). Personally, I think they're both providing exceptional service to their clients. As I see things: (1) The Australian/NZ regulator is relatively weak; (2) If your parent company is listed on ASX then your corporate governance is superb; and (3) Australia is the perfect location for servicing China.
