Recently, surrogacy was prohibited for Italian citizens, including where they engage in surrogacy overseas. Today we see news that an Italian couple trying to leave Argentina with their baby were arrested as they tried to leave Buenos Aires. It is unclear whether they were arrested because of their Italian citizenship, or, as is reported, due to the focus on an 'organisation allegedly exploiting women.' Criminalising surrogacy does not protect the interests of children born or the surrogates. What happens next? How can it be that arresting these parents leads to better outcomes for the child or the surrogate? Surrogacy should be regulated, and for everyone's interests, it should be accessible at home. Cross-border surrogacy in poorly regulated jurisdictions inevitably involves exploitation, and the profit-makers will simply find another destination when this one no longer suits them. #surrogacy #Italy #Argentina

This is the inspiring story of two courageous gay couples, one from Canada and one from California, who fought to have their parental rights recognized in France after their children were born via surrogacy. Both couples sought the French courts to enforce foreign rulings that had already established their legal parenthood. In a landmark decision, the French Supreme Court acknowledged the importance of weighing both the risks and vulnerabilities in surrogacy arrangements and, more importantly, the rights of the children and parents involved. Citing Article 8 of the European Convention on Human Rights and Article 3 of the UN Convention on the Rights of the Child, the court emphasized that the child’s best interest is always the top priority. However, not all parental rights will be automatically recognized. There are specific requirements, including a thorough investigation into the informed legal consent given by the surrogate, the risks involved for all parties, and the vulnerability of the surrogate throughout the process. The court carefully examines these factors before granting full recognition. Ultimately, the ruling was clear: when a foreign court legally establishes parentage for children born via surrogacy, France will recognize that parentage, even without the need for adoption—so long as all these conditions are met. This decision is a major victory, ensuring that the rights of parents and their children born through surrogacy are respected, while also protecting the rights and well-being of surrogates. Sir Ben Ainslie and Georgie Ainslie were recently in the news for revealing they used a US surrogate for their second child. Surrogacy is legal in England and Wales but in limited circumstances. Under new proposals the Law Commission is considering an overhaul of our domestic surrogacy laws and we may see, in time, a more regulated pathway. Regarding the kakistocracy issues surrounding Hon. Peter Foster MLC's role in the inquiry into forced adoption in Western Australia. The conflict of interest is glaring, especially considering his personal connection to adoption through surrogacy. Transparency, impartiality, and fairness are essential in such sensitive inquiries, and it's disheartening to hear about the alleged suppression of adoptee submissions. Adoptees' voices must be heard, and their experiences are crucial in shaping a more just and compassionate future for all those affected by both adoption and forced adoption. Australia's commitment to justice and accountability demands a thorough examination of this situation. Transparency and fairness should always prevail, especially in matters as sensitive as these! Perhaps I should tag the eSafety Commissioner or Australian Human Rights Commission in fear of being blocked again! #australia Why aren't we talking about this? Why can't we talk about this? Adoption plays a significant role in the context of surrogacy, although they are distinct legal and social processes. In surrogacy, a surrogate mother carries and delivers a child for intended parents, who may be unable to conceive or carry a pregnancy themselves. Once the child is born, legal processes, including adoption, may be involved to establish parental rights and responsibilities. What Issues is Peter Foster MLC avoiding, and what effects will that bring to people of adoption and, more importantly, his own children? Becoming a father is the most rewarding thing I have ever done. It changed my perspective on many things, including how I perceived career and work. I became a father via a wonderful American surrogacy birth in 2021, in the middle of Covid. America was one of the few options we had, as there is no provision for men to have children via surrogacy in Western Australia (WA). Since becoming a proud father, I have advocated for WA legislative reforms. Part of this advocacy was to raise awareness and acceptance of Gay Dads WA which now has over 300 members of current dads and intended dads. Also advocating for change through newspapers, radio, TV, social media, and meeting with WA Members of Parliament, have all been ways of raising awareness for legislative reform. Today I had the honour of meeting the Western Australia Premier, Roger Cook. Together with my partner and several other families that have been involved in surrogacy, we had the opportunity to share our stories with the Premier and advocate for change. Along with Hon. Peter Foster MLC, we had a husband and wife that had twins via surrogacy in the Ukraine because it is too challenging a process in WA, a WA woman that approached a gay couple to be a surrogate for them resulting in them having to move state due to the local legislation, and an intended father who is ready to begin his journey but waiting for the laws to change. My family's story is one where a cancer scare could have potentially resulted in our daughter going into the care system because my partner is not legally recognised under WA law, potentially losing not one parent but two. The Premier listened attentively to our stories and shared his compassion and determination for enabling Australians to have Australian children on Australian soil. He talked about the importance of families and community and his commitment to make legislative change for WA families. It was an honour to have had this opportunity with the Premier and we, like so many other WA families, look forward to seeing the new laws that will impact future families and create protections for children born through surrogacy. #lawreform #advocacy #community #families ##surrogacy #acceptance

So sad. The issue is, as I'm sure you know, there are a number of awful agencies operating there, exploiting and lying, which overshadows the good practice. Sadly though, I think this is the end of Argentina and I feel for all those IPs mid journey. If anyone wants to reach out to me, we're helping IP move embryos to our pathway in Mexico City.
