Understanding the status of the UPC from the perspective of Life Science Companies - today's panel with Sara Burghart, LL.M., Pedro Roman and Jiri Slavik at the Life Sciences Strategy Summit on IP & Exclusivity in Munich really provided a lot of insight on this topic. When it comes to venue selection, "predictability" is key for the industry; insofar, I am convinced that the UPC is delivering. Claim construction, novelty, obviousness - many key areas of patent law are clearly taking shape. An important area where room for improvement exists is access to the court docket: in a nutshell, this is perceived by some users as slow and cumbersome. Also, strawman requests for getting access are not possible since you have to disclose "why" you are interested in getting access. Summarizing, the industry is still testing the system - one foot in, but not with both feet (yet). #ThinkUPC #NoTeamLikeOurs

The Dutch branch of US e-cigarette producer NJOY brought several revocation actions against Juul Labs. The Paris Central Division recently gave two decisions. EP 3 498 115 ('Vaporization Device Systems and Methods') was revoked due to extension of subject matter. The CD gave some interesting considerations regarding late filed facts and evidence, the maximum number of auxiliary requests and procedural maxim. The annual AUTM conference remains the greatest way to get exposure to the broad scope of activities that relate to technology transfer, even for people who do not work in technology transfer offices. I attended my first AUTM conference more than two decades ago, just weeks after my responsibilities expanded to take a more active role in IP management on top of other research compliance and integrity issues. Just those first sessions opened a whole new world of understanding in a very short period of time. Many of the people I met then have since retired, but since the whole point of the organization is to pass down knowledge, that is represented by hundreds of new first time attendees each year. #researchadministration #technologytransfer #researchintegrity #federalfunding
