Double Garage Front Garden Planning Appeal Shropshire Council Case Study
Shropshire Council refused this application 19th May after originally validating it on 10th March. There reasons were stated as;
The proposed structure located forward of the principle elevation would interrupt the openness of the site resulting to a significant visual impact on the designed and approved landscape plan of the immediate surrounding environment. In addition, it is considered the scheme would have a negative impact by way of loss of natural skylight to the living room of the dwelling consequently, having an impact on future occupiers’ residential amenity. The erection of the garage would not respond appropriately to the locality and therefore contrary to Local Development Core Strategy Policy CS6, SAMDev Plan Policy MD2 as well as the overall aims and objectives of the National Planning Policy Framework in requiring sustainable development.
The Appeal Statement for this case that is shown in the video, was produced specifically to overcome the refusal reasons issued by Shropshire Council for this application. As with many of these types of refusals, the reasons are very subjective and as such require a comprehensive and robust detailed appeal statement. Never under-estimate the level of detail needed, covering policies both locally and nationally and where possible brining other approvals and appeals into the argument. We will explain in the video in more detail what and how to achieve this.
The Planning Inspectorate visited the site on 27th September and issued the decision on 14th October.

As well as the commonsense advice to ensure open communication around garden maintenance expectations, landlords are encouraged to “be realistic about a tenant’s capacities to take care of specialist garden plants or features”. It’s also worth noting that landlords retain the responsibility for regular maintenance of fixed features, such as steps and paving slabs
As tends to be specified as standard for residential letting agreements, tenants are responsible for the maintenance of green spaces as well as a property’s interior. Such obligation extends to timely reporting of any damage to outdoor space
Should concern arise, landlords are permitted to make periodic visits to a property to keep an eye on the condition of the garden, though such must be done only with a tenant’s express permission. Any visits require at least 24 hours’ notice and repair work undertaken should take place at a reasonable time of day

Creating more housing options in Toronto is important work, but it isn’t always easy.
Take this example on Craven Road, where the local city councillor has listened to the call of local residents who want to prevent their neighbours from being able to build garden suites.
They aren't alone in opposing new housing in their backyard (or front yard, in this case) - but it is a slippery slope to start allowing exclusion zones in city-wide policies like this. That’s a big part of how we ended up in our housing crisis in the first place: by letting existing residents say no to new neighbours.
It takes leadership to stand your ground on important housing policies like this. It’s why I went to the wall to defend the modular housing project in my community, and passed a motion to make the garden suite rules in my ward *more permissive and flexible* to ensure they could actually get built.
We need to be increasing options for new homes across the city - not creating exclusion zones.
