It was a pleasure presenting on dispute resolution and arbitration to building professionals in our construction industry at the Barbados Association of Professional Engineers monthly webinar. In addition to negotiation, parties to a dispute arising during a building project may resolve their dispute through neutral evaluation, expert determination, the use of a dispute board, mediation, adjudication and arbitration. Arbitration is a dynamic and binding private mechanism for dispute resolution. It is conducted before an impartial tribunal and is attractive to parties because it is created solely by their agreement. It is important to ensure that a valid arbitration clause is placed in the relevant building contract to ensure that it stands ready as an effective mechanism to resolve any dispute.
