1. The implementation of Tort Law and Tortious liability seems to have escaped our Judicial and Legal system 2. The concept of damages in liue of negligent breach of duty on behalf of Public Functionaries as well as common citizens must be introduced as a remedy and implemented to the fullest extent 3. Various organs of the State and State institutions rein freely negligent in Pakistan because there’s no check and balance on these institutions, Tortious liability and damages in lieu of the same can curb negligence enmasse on behalf of our Public Functionaries and common citizens 4. Our Legal and Judicial system must develop entrenched jurisprudence on the law of Tort 5. The landmark case of Donoghue v Stevenson, 1932 (UK) is a prime example of Tort law in action 6. We may refer to Justice Athar Minallah’s additional note in the “90 days Elections” matter as a “small step” for a Judge but a “giant leap” for the Judiciary as a whole
