Tom Beard's recent article for Capital Law Ltd highlights the renewed transparency obligations imposed by the Procurement Act 2023, and the impact the new obligations will have on procurement practices. With enhanced transparency, there is a higher risk of challenges from unsuccessful bidders and contracting authorities will need to ensure that they are sticking strictly to the rules. In the construction sector, unpredictable events during the course of works often mean changes are common and commercially required where, for example, newly discovered ground/ site conditions mean a fundamental change to the risk profile of a construction contract is required. The incoming requirements to publish a Contract Change Notice will mean a contracting authority's agreement to significant post-award changes in a contract's risk profile will be public information. Two stage tendering, where construction works are procured in two separate stages (pre-construction services and construction) would allow contracting authorities to have more accurate information on the works and the necessary contractual risk profile from the outset.
